Hi guys so basically needing some advice. Thought I’d explain the whole situation on here. I’ve been signed off work for anxiety and depression for 3/4 weeks and most of it comes down related to the job. I’ve always had anxiety and depression but wasn’t too bad it was quite mild. Ever since I started this job it’s gotten so so bad... been to doctors 5 times. I hate this job so much and I’ve got to go in for like a chat/ meeting with this woman at work
I’m currently getting certified sick pay/ssp I haven’t been paid it yet though
If I resign and give them a notice letter etc, can they refuse to pay me ssp? My boyfriend says it’s legal for them to do so and that they have to pay me for any money I’m owed. I thought they can refuse to pay if I resign but he’s adamant that it’s illegal for them not to
Slightly confused? I just can’t go back there I hate it so much and I’ve got two interviews soon. Will they hold back my SSP

The only grounds not to pay SSP if you qualify, and are still in employment, is if the employer does not believe the illness to be genuine, and that would be difficult to prove in many cases.
Once employment ends you will no longer be entitled to SSP.0 -
Yeah they are paying it to me as they have already said to me it will be paid to me.
But I didn’t know whether if I just resign and leave they will hold it and refuse to pay0 -
They have my doctors notes aswell to prove it’s genuine.
So in other terms I will get paid for the 3/4 weeks I’ve been signed off ? Just nothing past the date I resign0 -
Why would you resign when you're entitled to SSP for 28 weeks? If you did this then you no longer work for the company so won't be entitled to SSP.0
-
You will be paid SSP for the period you are employed by them. Don't know exact figures but kicks in after the first week. But if you resign, then you won't get it beyond the date of your resignation (or end of employment). SSP is an employment benefit. If you are not employed, you won't get it. You should still get paid for the period you have been off (assume this will be in your next salary payment)0

I can’t live off SSP for 28 weeks it’s not enough and I certainly would not be signed off for 28 weeks either. Almost can’t physically afford it
I need a new job as got bills to pay rent to pay etc. But I just wanted to know that if the SSP I’m owed from the past 3/4 weeks whilst being signed off if I will still receive it?0 -
Yeah see that is what my partner is saying. So I should get the 3/4 weeks SSP pay then0

Wouldn't it be better to stay where you are until you find another job?0 -
Yeah so I should get whatever I’m owed as in the 3/4 weeks ssp and that’s it right?
I have two interviews this week so that’s why I was asking sort of prepping myself. If I get one of the jobs then at least I know like what’s happening with my sick pay0 -
If you leave your job for another job whilst being on the sick then your employer could dispute that your illness was genuine and could refuse to pay you the SSP.0
