    Theyve tried to do the good customer service thing though and save you having to pay a fee. And because they didnt want to charge you you want a refund? That doesnt add up.

    Either way, they aint playing ball, youll need court.

    You ordered something apparently its gone next door and you didnt recieve it and now you want it refunding. You dont even want what you ordered originally? It was time sensitive, I no longer need it

    Cant remember if you ahve to take the hit on the delivery charge or not?! No, they would send a replacement free of charge

    why didn't you follow their instructions to contact them to let them know nobody would be at home? I forgot the delivery was that day

    If they have adhered to their terms and conditions, I don't have an issue. However, they are going against their terms and conditions, are they not the binding contract between us when I place the order? If they violate their own terms of service, am I not eligible for a refund? Their own terms of service say I am from what I can see.

    7. CANCELLATION AND RETURNS

    Ending the contract because of something we have done or are going to do. If you are ending a contract for a reason set out at (a) to (d) below the contract will end immediately and we will refund you in full for any products which have not been provided. The reasons are:
    (d) you have a legal right to end the contract because of something we have done wrong.

    That company largely sell large items of furniture (beds/dressers/wardrobes)


    your evasiveness makes everything look suspicious.

    why are you being so evasive? what was so time sensitive? It was a bedside table that I needed to have for the following week, because of the missed delivery I went and bought my own, so that's why I'm not interested in them sending me out another one

    With regards to this case. The main question I have left after all the responses thus far is, if a company breaches their terms of service, which in this case they have. Is that not grounds for a refund? If I'm mistaken please let me know.

    I am aware - I was merely being very sincere and sympathetic to the fact that this happened earlier in the month to you with a mattress...I mean how unlucky can one guy get!... im sorry this happened to you (Twice in a month)


    Im glad you got your refund and its all resolved now.

    You also broke the terms and conditions by not having someone there to receive the delivery.
