Post Office parking ticket

Hello,
I've not been here for a while but I’m a little stuck. I've been given a private parking ticket after parking in a post office car park to post some presents just before Christmas. There is big a sign that says ‘parking for post office cutometers only or a £100 fine”. I was obviously ok with this as I was parking to use the post office.
I received the ticket a few days later and obviously wrote to them to tell them I was parking to use the post office and therefore expecting them to realise a mistake had been made. They have written back to me and said there is no proof I used the post office and I should have entered my car registration into the computer in the post office. I paid a visit to the car park to check on this and there is a small sign with small writing telling customers of the post office to type in their car reg into the computer inside the post office. I obviously didn’t see this and was not informed when I went into the post office. I’ve requested CCTV to prove my innocence but the royal mail won’t let me have it as I’m not the police.
The only thing I can think of to is the small sign with the small print was only on two sides of the car park and where I parked the sign wasn’t there. Is there any rule that says the sign should be visible on all sides of the car park? If so I can quote the rule/law to them and shut them up 😊
Thanks,

Are you sure this is a fine and not an invoice from a private company. AFAIAA, the PO can not fine people. If it is not a fine please tell us the name of the parking company who sent the invoice. You never know how far you can go until you go too far.0

Sorry to ask but how do you start a new thread? I can only see reply options0
-
Yeah, I know it's not a fine but the sign says 'fine'. It's defiantly a private company.
As the sign says 'fine' and I have pictures of it, does that help me? AS the sign is technically incorrect0 -
Do the parking company signs in the car park tell you that you have to put in your VRM? Get photos of those. Is the small sign a PO sign or a PPC sign?
Which PPC is pursuing you? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

They're called Civil Enforcement LTD
They do say that but the side I parked on does not have the terms and conditions which I have a picture of0 -
If the sign sys fine, PoPLA will find for you, but ar you sure that it uses the eff word? Who are the PPC?
The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..
All five readings are available to watch on the internet, (some 7-8 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers. You never know how far you can go until you go too far.0 -
You need to do a POPLA appeal showing photos to evidence that inside and outside, this hidden keypad just is not adequately signed, especially in poor light in Winter.I received the ticket a few days later and obviously wrote to them to tell them I was parking to use the post office and therefore expecting them to realise a mistake had been made. They have written back to me and said there is no proof I used the post office and I should have entered my car registration into the computer in the post office. The only thing I can think of to is the small sign with the small print was only on two sides of the car park and where I parked the sign wasn’t there.
So if you didn't also take pics inside the PO, you need to do so, just general ones, not close ups of the keypad you didn't see! quite the opposite...
See any POPLA appeal about a hidden keypad. You can search for those words and I am sure you will find one already written in 2018, to adapt and show us your version.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Why would Royal Mail have any access to Post Office videos?0 -
The OP posted this in the wrong place so I brought it here:splodge2018 wrote: »I parked in a post office car park near xmas last year. The signs on the wall said 'free parking for post office customers'. I was in rush so parked my car for 12 mins to use the post office and they sent me a ticket in the post from their CCTV cameras .
I apparently should have put my details in a computer in the post office but I didn't see anything as was rushing. I did say I this in a letter hoped that they would realize why I only used the car park for 12 mins as was posting something. I asked them to check the CCTV but they wouldn't. I even outlined a story in my local paper that another person in city did the same thing as me and they had the ticket rescinded. Yet, they keep sending me letters.
I have written to them a few times. the last time I wrote to them I wasn't admitting anything but did ask if I could pay less to stop with the letters as it's effecting my stress levels and am on ant-depressants and don't need this in my life at the moment when I did use the post office like I was meant to.
This is the last letter they sent me and I'm worried to death as don't have the £140 they're are asking. What should I do? If I get taken to court don't they need to tell me this and I have a right to put of a defense before it goes to court?

And this is/was my reply:You need to calm down and read the NEWBIES thread (see my signature below). You seem to have missed the fact the sticky thread already covers all of this in the second post #2 there, including an example defence about a hidden keypad...all there for you.
