    Why are you mentioning a grace period when your opening post says the permit was on display/ That just indicates that your initial claim is false.

    Far better to dispute the charge and to demand all photographs and if none of them are of the windscreen, that screams a "WHY NOT?" to me and should be any point of defence in court. They need to prove no permit on display and if they have photos of the number plate, car at distance but not the windscreen, they are pushing water uphill.

    You may have clouded the issue with reference ro Grace periods and made you look evasive.

    Hi,

    thanks for a quick reply. I thought it would make sense to challenge both - their inability to prove the permit was not displayed based on the photos provided and the fact their claim is based on a very short period of time where the car was allegedly parked without a permit. Plus all other arguments suggested in similar cases. There is a photo of a part of the windscreen but in no way can it be proved it was my dad's car (no number plate visible) or that it was taken at the residential car park. What do you suggest I should do now?

    Should I continue a further letter exchange or ignore and wait for a proper LBC?
    If you have already done a SAR to the DPO of the parking firm, then there's little to be done at this stage.

    Clearly people arriving at a permit site need time to fetch a permit/read signs.

    Hello All,

    I have been dealing with BW legal since 2018 - please see my original post - https://forums.moneysavingexpert.com/discussion/5956182/countrywide-parking-management-ltd-appeal-denied/p1

    Once a year around September they would send a "Letter of Claim" to which we responded raising all the usual arguments about grace periods, contract with landowner, blurry photos etc. Then they would reply they would start court action but never did. In September this year they sent another letter of claim. I replied as always and in October we got a letter saying we misunderstood grace periods, that photos are sufficient and that they don't have to provide evidence of the contract they have with the landowner. They also said "We hope it clarifies the position and you now make a payment". We have not replied to that letter.

    On 29th November they sent County Court Business Centre Claim Form from Northampton. It arrived today. I am about to acknowledge the service and prepare the defence. 

    I have read the threads about defence preparation and I think I understand the key points but still need some guidance.

    First of all I am not sure if we have actually received a proper LBA. Is the letter of claim a LBA? What if we haven't?

    Secondly if it goes to court does it mean we have to go to Northampton? Can it be changed to a local court? We are in Dorset. 

    Can anyone help please?

    They Claim a total of £290.76 - debt and recovery costs + interest + court fee + legal representative
