Speeding - Scotland

41 in a 30 is definitely in fixed penalty £100/3pt territory. I think it's about on the threshold of a course, but IIRC Scotland doesn't do courses anyway.0

I pulled that one about 12 years ago before it became a single force, not sure I would try it now.0 -

I do believe that the advice is still a "fill in S172 but return unsigned" nothing has changed according to pepipoo.AndyMc..... wrote: »Why? Scottish law won't have changed because the forces merged.0 -
Looks like another amber gambler getting his collar felt.0

Not signing in Scotland is still an option - furthest away you live from Scotland the more chance you have of not having a knock on the door.
Look at Pepipoo for more information (search there for unsigned) - police have 6 months to get your signature and will chap your door to get it, so if you can 'be out' for 6 months then its an option. If you live in Scotland you may get a copper at the door three or four times - if you live in England, maybe once or twice.0 -

Remember you have the 28 days to pay your fine or you'll get cited for Court. Receipt of the fixed penalty is seen as acceptance, so non-payment gets referred to the Fiscal to take to Court.
If they have asked you to identify the driver of the vehicle, for instance there are more than one person insured and you're the registered keeper and insured, I don't think you can claim someone else was driving or be prepared to prove it. Failure to identify the driver is also a separate charge I believe.
41mph in a 30mph is in the safe zone for a positive prosecution in Court also, in other words the Court doesn't tend to be lenient, first offence or not.
I personally keep in my head that I don't want to pay out £100 to anyone other than myself, this keeps me within the speed limit. if you're late, better to be slightly late or really late if you get pulled for speeding.
Just my tuppence worth. Thanks to all the competition posters.0 -

Aye, but I reckon there is more chance they will come knocking at your door. In the old days you could argue eg Strathclyde police wouldn't be arsed chasing a Lothian and Borders ticket.
It might still be worth a shot but you need to be prepared for them arriving at the door.0
