Being charged £100 fine for parking ticket I did not receive

Hi all

I parked at local station back in November (I usually walk).

I paid on Indigo app in the afternoon (I forgot as I usually don't use the car).

There was no ticket on my car when I returned to it that night.

A couple of days ago I received a penalty/debt notice asking for £100 as I had not paid the initial amount. I called and was told to email the railway company parking people. Which I did.

They sent back photographic evidence of ticket on the car. Taken earlier than my payment.

But the ticket was NOT there when I got back to the car. Goodness knows why - but it wasn't (maybe someone was having a laugh and took it off - kinda town it is).

I explained this - and said I would be happy to pay the initial amount but as I did not get the initial ticket, I feel it's not fair that I should have to pay this massive hike (which will go up further of course).

They are not having any of it and say they will not communicate further. Seriously. £100..? I paid for half the day as it was - although I do realise I am in the wrong regarding that, as I was there all day.

I have asked again - and said I am happy to pay the initial amount but I don't know what else to do.

I did say to them, why on earth would I have left it, knowing the fee would go up?

I did not get the ticket. They may have put it on the car but I did not get it.

Does anyone have any advice at all perhaps please? Bit desperate.

    What a shame you didn't come here first. I'm guessing that you blabbed about the driver's identity. This is not fatal if byelaws apply, but it is never advised as a starting point.

    You need to read the sticky thread for NEWBIES to understand all about this scam and how the scammers can get the keeper's details from the DVLA. They don't need to leave a windscreen ticket if they use ANPR cameras.

    The most important thing now is to determine whether byelaws apply. Did the keeper get a PCN or a PN?

    and complain to your MP as the whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    They can be ignored.

    Send the template in blue from the NEWBIES thread to the PPC.

    Add a one liner that since byelaws apply and this is not relevant land, neither the driver nor keeper are liable so they should cancel now and save themselves some money.

    Common acronyms are explained in post 5 of the NEWBIES. You should print them off or write them out for reference.

    Are they really from the railway company, or from the PPC or the debt crawlers? It is crucial you give us correct and accurate information if you want advice.

    I have already explained why you didn't get a windscreen ticket and this is not a requirement for the scammers to do so.

  • I am sorry - I don't understand. You may have explained - and thanks - but I am new to this. They sent me images of my car with a ticket on it. I am giving you information as you ask for it - I don't know till then what you need.

    The letter was from London & Southeastern Railway Ltd trading as Debt Recovery and Prosecution Service,. Registered office in Newcastle. (this is at the bottom of the PPN).

    I will look at the NEWBIES bit.
  • I have looked on NEWBIES and to be honest I have no idea where to start! There are so many things listed there I don't know what I am looking for. It's really confusing - sorry. I am trying you know - I want this sorted out!
