Advise Excell as to your new address. Refusal to engage with the appeal process will have no detrimental effect on any court proceedings. In fact the judge probably won't even be aware of it.
  • no ignoring the IAS will have no effect at all.
You should definitely write to excel and copy in dataprotection@excelparking.co.uk and explain that under GDPR you have a right to you have data record rectified, then no excuse for them

I feel like advising a company like that a change of address is insane

My new address is linked with DVLA and With my car lease company so when they go to gather keeper details they should be able to grab my new address like that shouldn't they?

Ive spoke with my lease company and they have said they will pass this off onto me as I said I was the driver.... so even if they go through to the keeper they will give excel my new address surely???

I wouldn't panic about telling Excel your address. As long as they have the correct address it's ok. The last thing you want though is court papers going to your old address. That ends up being a nightmare.

Come back when they try a small claim and we will assist you, no risk, nothing bad and 99% likelihood of a win, by following our advice.

We saw four reported court wins today alone! And they were awarded costs.

Have you contacted the landowner? If the car park serves the company you had the appointment with, that simplifies matters because you complain to the company's manager. If it serves several premises there will be an overall landowner or land management company and the simplest way to find out who they are is to ask the stores / businesses.

This is something you do as well as fighting the parking company head on, it's about exploring every avenue. We can easily feel very small when these things happen, but businesses do not like customers being deterred by parking scammers. Fighting the scammers - you follow the method outlined on this site. Complaining to a landowner - you can tell it like it is to a much greater degree (though without revealing the driver's identity). As the situation you describe is so clearly unfair, you have the basis of a very compelling complaint / demand for cancellation.

FWIW, I think there's a good chance that anxiety can ultimately be lessened by standing up for ourselves, even if it peaks at certain points in the process. It sounds like you're already feeling the positive effects of fighting back!

Thank You very much for your great response.

The parking was a 15 minute walk from the town center of where I had my appointment. SO there is a small chance that they work with each other. But I will still give it a go. In a certain sense drivers identity was already declared in my initial appeal directly to the parking company.

Guess I thought they would have an understanding that I would not try to avoid paying £2...

But yeah feel like evidence I have is good enough, so I won't be paying it and I will just hope its good enough.

Majke sure you state this is your new ADDRESS FOR SERVICE, and they MUST update their records to reflect this notification.
You will use this email to hold them liable for all damages and costs should they use the old address in anyway past this date.

They do not care one jot about they the ticket was issued. They only get paid if they raise tickets and those tickets are then paid.
