The only charge the premium for CC and Debit cards, Cheque, bank transfer, & cash are all not subject to the charge.
The only reason I mention it is that a 4p per minute surcharge on a Council Ticket seems to be adequate evidence that they are acting unlawfully and seems to get tickets cancelled. I thought this might be similar. In the case above, It seems that even though they offer multiple ways to pay, the fact that the payment line is a premium line was enough.
As I understand it any surcharge for Credit and Debit cards is unlwaful, that's got to count for something?
I'm sure it's a totaly different situation but didn't want to not mention it and later regret not spotting an easy out.0 -
You are right but it has been tried before, and doesn't dent a private scam PCN - I mean it doesn't make it void like it would a Council one.

I've had a few attempts to contact the directors of the company that used to operate from the premises, No luck so far, looks like whomever ran the company has moved to wales, all listings with phone numbers report number invalid upon calling, no website of use either. There is a very similar sounding company who work in an almost identical way running out of a Towcester garden center, they where shut today but I will give them a call tomorrow to see if they can assist in any way as I seem to recall someone saying they where related.
Checking out Google Street maps images I can see signage saying closing down Febuary, I'm guessing they must have closed shortly after.
If the company that was operating from there was renting, does that mean the contract for enforcement would be with a different party? If so how does one go about finding who owns the property and might have instructed NPM?
You can also see the NPM signs they are propped up inside the windows, one on the wall the far side of the building and one on a temporary fence panel. Would it be considered reasonable for these to be adequate?0 -

Contravention was "Parking in no parking area", The shop in question has been closed down for quite some time. I was parked in a bay, one that I'd previously used when shopping before with them before they closed up, They've never had Pay and display, guess the signs have gone up since the shop closed.0
