    This is not KPS 'reportedly' leaving the IPC. I asked for it to be struck off because of the overhwhelming evidence I submitted to the IPC and DVLA. It will not be a temporary ban, nor will the director be allowed to start a new company to gain access to the DVLA database.



    Following this incident, a parking company simply being a member of the IPC would be insufficient for the release of my personal data in similar circumstances. I demanded the IPC remove my data (the pcn was cancelled a while ago) and I copied in the DVLA legal team.

    Sorry I didn't mean to offend, I just meant whoever fancied submitting a FOI to the DVLA needed to couch their question that way, simply to make the background clear.

  • I am not offended. I just wanted to be clear that any parking operative who has obtained a driver’s personal details via the DVLA by deception is a criminal and can never again be a member of an ATA (for what they are worth) and access personal information. If an ATA is seen to condone this behaviour simply to profit from the membership fee then it should be reported (and also struck off). Initially the IPC only deleted KPS from the accredited members’ section of its website, leaving it as a corporate member. I wrote every day for 6 days asking for it to be removed from the entire website and copied in the DVLA legal team.



    It is disgusting that people are having to negotiate with criminals and are being bullied into paying illegal PCNs (note I have no argument with PCNs issued within a legitimate contract).


    My matter is already in the civil court process and if the police then take no action I am fortunate to have the time and resources to bring a private prosection - I will settle for nothing less than a criminal conviction.

    This is great stuff. I drafted letters of complaint about KPS to the DVLA and IPC but haven’t got round to sending them yet. Still worth it? If so, do you have an email/postal address to send them as I can’t seem to find anything relevant on the internet

    I wrote to the DVLA to complain about KPS and requesting that they confirm whether they are a member of the IPC.

    I got a profoundly unhelpful letter back that was unsigned and misaddressed (apparently the DVLA have assigned me a new gender...):

    “Thank you for your email regarding the above VRN.

    I can confirm that DVLA has acted in the appropriate manner regarding the release of information.

    I can confirm that Kernow Parking were members of the IPC at the time of the incident.

    DVLA do not get involved in disputes.

    I would suggest that you take your complaint up directly with the IPC- the International Parking Community, Waterside House, Macclesfield SK109NR. If you are not satisfied with their reply, you can take it up with the ICO- The Information Commissioners Office- 17 Churchill Way, Cardiff, CF102HH.

    Hope this helps.”


    In related news, Debt Recovery Plus apparently haven’t got the memo about KPS no longer existing and have ignored my letter telling them where to go and not to contact me again. So they just sent their first Zenith letter to me where they’ve quietly decided to increase the ‘debt’ (although depending which paragraph you read, it has either been increased by £36 or £60)

    After reading this thread I sent the following to the DVLA:
    I would like to make a FOI Request to the DVLA related to "Kernow
    Parking Solutions Ltd (Company number 10144662)"
    It has been suggested that the DVLA have banned this company from
    accessing the DVLA database of registered keepers.
    Can the DVLA confirm if this is true or false?
    If it is true, what was the reason(s) for this ban, and how long is it for?
    If the ban does exists, could the DVLA also release any correspondence
    between the DVLA and Kernow relating to the lead up and
    implementation of this ban.

    ... and this was the response:
    The DVLA does not hold any information within scope of your request. The DVLA
    has not suspended Kernow Parking Solutions Ltd facility to request vehicle keeper
    data.
    Under the DVLA’s duty to advise and assist requesters (Section 16 of the FOIA),
    please note that the DVLA requires private car parking operators to be members of a
    relevant Accredited Trade Association (ATA) before providing vehicle keeper
    information to them. Requiring ATA membership helps to ensure parking companies
    operate within a relevant code of practice.
    I can advise that Kernow Parking Solutions Ltd no longer has the facility to request
    DVLA data. This is because their Accredited Trade Association (ATA) membership
    expired. Notification to this effect was received from the International Parking
    Community (IPC), on 22 February 2019.

    Given that Kernow Parking Solutions Ltd only had the facility to make manual
    (paper) applications, any requests made by them would be rejected on the basis that
    their ATA membership expired on 22 February 2019.

    So it seems, from the DVLA's point of view, Kernow are now only prevented from DVLA access because as of the 22nd February 2019 they are not part of an ATA, rather than the DVLA banning Kernow themselves for any reason.

    Someone else did another FOI to the DVLA about KPS too- I can’t post it as a newbie here but googling ‘what do they know Kernow parking solutions’ should bring it up.
