To let you know that I have dealt with this scam company and had it struck off the IPC website today. It can no longer obtain drivers’ details from the DVLA and has never legally been able to.

It's definitely not showing on the IPC ATA list. :T

I think the regulars, including myself, would be interested in knowing more. If you have the time would you start a new thread on the subject please?

Are you saying that Kernow Parking Solutions are permanently or TEMPORARILY suspended by the DVLA and can't get data?

If so, what did they do that was so bad as to get banned?

I was the victim of a KPS scam in Mousehole. The DVLA sent me the V888/3 where KPS lied and said it had put a notice on my car (which it has to if no ANPR or have good reason not to) - it had not. The meter was set to the wrong time. It also had a note on it ‘NOT IN USE’. It has been a really tough battle with the DVLA and the IPC but I would not give up. I believe a landowner has the right to charge to park but if you know you are a victim of a scam - fight it.

Oooh, can you give us some scans of some redacted emails that have not been marked as addressee only? Use Dropbox and get a 'share' link to your pics.

Especially the one that tells you they have been PERMANENTLY banned by the IPC, let's see that please, and anything that talks about the results of the DVLA/IPC investigation that you can divulge.

Which exact car park and how did you find out what they'd done?

You are new so you can't post working links. Change 'http' to HXXP instead.

Finally, why not go to the national papers to publicise this, they will love it.

Please note that this is not advice and is my position as a lay person on my own particular case.

I have not received any emails from IPC other than one stating that it does not respond to emails! I would not use the IPC appeal process as I refused to be part of a sham where the system is not independent with shared directors, shared addresses etc etc. I have been shocked that the DVLA so easily hands over motorists’ personal details to scam companies that are profiting from deception for a mere £2.50 each and have served a summons against the DVLA.

KPS bombarded us with demands for payment and we have sued the director personally for acting illegally and outside the company’s best interest. However, he lives in a caravan just off a main road on a third party’s land and has no assets but nevertheless he will have to answer in court for his deception. I have served a summons on the IPC for negligence and breach of our personal details and failing to make any proper checks on the company. KPS‘s accounts show a company of no substance and reflect it was set up merely to benefit its director and gain access to the DVLA database contrary to company law. The local police were ineffective and said it was just a civil matter failing to understand that the offences (the V888/3) show many others were victims of the same scam) are contrary to the Fraud Act had have been committed many times. I will be raising a complaint with them once everything else is resolved. It has been a horrible in that these people who operate in this disgusting way live 15 minutes from us. Mr Ley is a martial arts expert and his friends and family are not people we would associate with. If anything happens to us or our property (Mr and Mrs Ley if you are reading this) they will immediately come to mind.

I have been a follower of Martin Lewis since 2004, but these are my first posts. I am a private person, not on social media etc but feel this matter is of massive public importance and I should speak out. It is ludicrous that a couple in a marriage or civil partnership cannot be seen to breach the Data Protection Act even when it is beneficial to that couple and yet car park thugs are breaking the law and accessing our personal data every day. It has to stop.

I will post an update which will probably be in several months’ time. Meanwhile, I am sure that the DVLA are now conducting a major investigation into the IPC’s conduct which is a disgrace.

Maybe someone needs to do an FOI to the DVLA, for all correspondence relating to and leading up to KPS reportedly leaving the IPC, and ask the DVLA to confirm in the FOI that this is not a temporary ban and that they can't get keeper data at all until they are in an ATA.
