Yeah but wouldn’t the rental company forward my brothers details to the pcn company later on?and the whole point of this cat and mouse game is for these private parking tickets companies don’t find out the keeper or the main driver even thou he wasn’t the driver on this day :eek:0 -
yes the rental company should follow BVRLA guidelines and follow POFA2012 and name the hirer, who is also the day to day keeper on the day in question
that hirer MAY be the driver, or may not, as in this case
that HIRER can then decide if they should appeal as keeper (hirer) or name the actual driver
until then its nothing to do with you, as its not in your name, so if its not in your name , YOU do nothing (other than help by doing the research)0 -
If this was a windscreen PCN, don't use Edna Basher's appeal that tells the PPC they've failed with their Notice to Hirer. Because there is no NTH yet and you want to keep the rental firm out of it.
For a windscreen PCN, wait till day 25 then send (NOT BY POST!) Wing the usual NEWBIES thread template and then the rental firm will never be contacted. It is OK for a rental lessee to call themselves the 'keeper' because they were.
You can remove the bit about PDT machines from the template.
Then repeat the NEWBIES template to the Council, being mindful of the shortened appeal deadline (14 days I think, just do it immediately). The hirer can safely add, at that stage, that they cannot be held liable because the driver has never been identified and this is not 'relevant land' being Council owned.
Then win at POPLA by pointing out the stuff discussed today, in POPLA Decisions.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

What you don't do is blab about being the driver and add words to the template appeal in the newbies thread, which to be fair, already tells you what to say, and to add your name and address...
Diarise day 25 right now.
Check that the PCN can be appealed online/by email.

Update on my appeal....
I need urgent help on what to do next please...
After I waited the 25 days I’ve sent them the Newbies thread template. I haven’t heard from them for 2months, so I called them up yesterday and they’ve informed me that they did reply to my email the following day rejecting my appeal. (BTW I didn’t receive any emails from them at all - Ive even checked my junk mail nothing). So what do I do now, please advise?0
