    I'd email them again. You've basically been referred back to them by KMP. Send the email to anyone whose email addy you can find and, without being rude, be very assertive.

  • So took your advice and emailed CBRE again forwarding the email from KMP, and finally received a reply earlier today. Unfortunately not the news I was hoping for.

    Thank you for your email sent to my colleague.

    I am afraid that as CBRE do not manage the Portswood Centre any longer we are unable to assist you. You could speak to POPLA who is the parking Ombudsman about the matter and they might be able to provide some advice.

    You could reply and point out that under the law of agency they are liable for the conduct of their agent at the time, and they are responsible in law for any losses you suffer as a result of their failure to carry out due diligence and allowing a parking firm to 'enforce' during the hours of darkness, with unlit and woefully inadequate signage.

    When signing the contract, CBRE had ample opportunity to properly risk assess the effect on customers and to consider why a firm contracted by them, given carte blanche to harass motorists on CBRE's behalf, would use unlit signs in the dark, except as a deliberate tactic to scam people.

    CBRE can't just wash their hands of what they have inflicted on people here.

    Tell them Britannia are currently suing the pants off people (claims galore flying in in their hundreds every month) and if you end up paying you will pursue them as jointly and severally liable for the intimidation you are suffering and having to defend, to your enormous distress.

    End up by suggesting that they never employ any parking firm, at all, anywhere, and need to wise up about the industry, given even Parliament realises they all operate an 'outrageous scam' (Hansard 2.2.18).

    It's unlikely to get anywhere but mention your distress, in case you fancy suing them for your losses if you end up paying Britannia.

    Landowners and Managing Agents should be targeted more.

    Only costs £35 to file a claim for up to £500 IIRC. That's why PPCs do it!

  • Yeah agreed, it also baffles me how they’ve cancelled some other fines recently from the same car park, and now suddenly decided they’re not able to assist..

    State you'll add them as a part 20 claimant, as they're fully liable. This means they get to share the costs when you win.
  • Another Update!

    Britannia's data protection team have asked me to confirm my PCN number, Registration and address before they continue with my SAR. In the original request email, I confirmed my address but apparently they still can't find my details.

    I've also had a letter of claim through the door today, will check some other posts in regards with what to do.

    As far as I know, my response to CBRE has been passed to the 'Property Management Team' so is still being dealt with.. Hoping this will bring some better news!
  • I'm very interested in how this progresses as i'm battling exactly the same case of my own with these scumbags! Mine was late night parking at Portswood Car Park in March 2018 too. Have spent hours and hours reading various posts on this site in prep for my own battle. Good luck with yours!
