Thanks Coupon-mad. I didn't see your reply last night as I didn't realise there was now a page 2 now to this post.
I've amended #6 and 12 (as was, now 11 after renumbering) thanks.
In #5 I was pointing out that the notice to keeper was sent after the allowed period. I'm not denying being the keeper or the driver.

But you can't use the deadlines in the POFA unless defending as registered keeper only.

POFA deadline arguments relate to 'keeper liability' so not for an admitted driver.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ah okay thanks for clarifying that.

I'll remove #5 and get the defence sent off.
    Cheers

You still have over three weeks...
...you have until 4pm on Wednesday 5th June 2019 to file your Defence.
    Don't rush this.
  • Hi,

First, I hope you've had some luck with this.

I have almost an exact same experience to the OP here - Only real difference here was I wasn't the driver at the time - Sennen and Armtrac, and a flipped ticket though.

Unfortunately for me, I failed dismally to get photos, or keep records of the original PCN and NTK, etc. (The original NTK also arrived after 56 days - although I have no proof of this any more - I left everything filed in a drawer in my previous job).

In this instance, would most recommend that I just pay the amount (£160 - BW Legal have got in touch)?

Or would you still wait for further action?

    Any help appreciated.

If you need advice not covered by the newbies FAQ thread near the top of the forum then you need to start your own thread and not hijack someone else's like this

No-one here will advise you to pay

There are loads of Sennen threads, so please search the forum.

  • Thanks, apologies for the hijack, got a bit carried away with the similarities, but having read through some more of the forum it appears there are sooo many similar cases I was being somewhat naive...

Seems I'm at debt collector stage anyway, having read the advice here I will just wait until something more interesting turns up.

Just wanted to say thanks though, to all the people offering their advice/support/time on here. It seems there is a bit of an issue with people (like myself) jumping the gun and posting before reading. I hope you all understand we're mostly just people inexperienced in this area who have got a bit bothered by the letters/threats/etc. so have a tendency to jump on the first bit of useful info we find. No harm meant by it.

Either way, your time is very much appreciated, and it looks like you're making a genuine difference to many of these cases. So keep up the good work! (please...)

    Good luck el_ferrito.

Just logging that I have received the Directions Questionnaire and have completed it following the advice in the Newbies thread. Will post back to Northampton CCBC and send a copy to BW Legal.
