Here is a PPS case where PPS discontinued when they saw the defence:

Plus on that thread, I list eleven other cases running at the time with PPS claims, all of which will have their defence showing (I think I wrote a couple of them for Matilda13 and/or phoenixfreespirit I seem to recall). Maybe not the same as yours, but worth you reading them all.
Got to be worth you looking the 11 members up (Community tab, search members) and finding their threads and how they got on and if there's anything in their PPS defences that you can also use.
Your defence start looks good, but you can add more, and certainly need to call into question the clarity of the signs, no agreed contract to pay £100 - and that PPS are not the landowner (unless you've seen proof that they actually do lease the site?).
If so, how about reporting them to the Council as a 'concerned citizen' (do give your details in confidence though) and speculate whether they have declared to the Council that they are running the car park as a business and are they paying Business rates, and have they got advertising consent for the signs and hoardings? And if you get back a favourable reply saying the Planning team are investigating this, you can then mention this investigation in your defence, too.PRIVATE 'PCN'? Thanks Coupon Mad,
I've seen the lease agreement supplied to say that PPS are renting the space.
The signage says and I quote ''If you park in this car park contravening the terms and conditions listed, you are contractually agreeing to pay a parking charge of £100 (reduced if paying within 14 days).0 -
Standard dross for signs but often the t&cs are high up/unreadable (unlit if it was dark)?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hmm. That's the trouble. The signage is clear, just over head height and quite large font.0

Hi Coupon-mad.
Starting yet again to try and come up with a good argument. The car park in question is at postcode EX43ER0 -
Get a photo up so we can see the signs.
Far better than GSV.0 -
Just trying to upload the pictures to a host site. I might add that these are pictures that I have taken with a decent camera. The ''evidence'' emailed to me by BW Legal are pictures of appalling quality that you cannot read the instructions on.0

Hi guys,
I have finally received details from PPS of the parking infrigement.
It is just two readouts of a Parkeon machine showing parking times paid for on two occasions, one of which the charge is for and this one has a partial VRM.
I am slowly building a case and will post a defence very shortly as I'm aware that the date of 11th Feb is looming0
