I've now requested the additional info of the parking ticket coverage time and grace periods, etc.
Can anyone kindly direct me or tell me how to search for some example overstay defence letters just to get me started please? I think my head is going to explode otherwise.
Also, the site in question has no landowner identity info on the signage. Is it worth me asking for this to enable me to see PPS agreement with the landowner?

The driver was late returning to the car. As it was quite some time ago now the driver cannot remember how long overdue the ticket was but she thinks about 10 minutes.

Hi everyone.
So I insisted on having the ''data'' regarding the parking ticket info from PPS. They have stated it is info outside of personal data and said that BW legal could supply this. I have contacted them and after a bit of messing about they only sent me pictures of the site, signage, etc. No PDT readout and no info on the ticket purchased. Can I just put a defence in stating that as no ticket information can be given that an overstay period cannot be proven??
I have fortunately/unfortunately got a few days off from work with a bad back so I have a bit of time to sort this.0 -
What I have also received from BW legal is the lease agreement for the land the car park is on. It appears that PPS have rented the space from the landlord to use as a car park. There is no info on grace periods in the document.
They (PPS & BW Legal) seem VERY reluctant to supply the details of the ticket purchased. Would I be foolish to assume that they cannot supply this for some reason? Could I just defend this by asking them to prove an overstay occurred?0 -
Data showing YOUR reg is YOUR personal data, so you need to make it clear that you need this from teh PPC through a SAR
You can indeed state that the claimant has refused to support their claim with any documents showing an allleged overstay, and so you can only presume these do not exist.
State you require a list of ALL payments v VRM for the day, with non-matching VRM redacted; the first three char must be left, to show they are not your VRM. THis will narrow the issues under dispute.0 -

So I've sent off another request both to PPS & BW Legal asking for the PDT readouts and parking ticket details. Now awaiting a reply.
Here is the start of my defence. Does it seem okay so far guys??

Premier Parking Solutions Ltd

XXXXXXXX (Defendant)
DEFENCE- The defendant denies being the driver of the vehicle XXXXXX on the day the PCN was issued.
- The facts are that the vehicle was captured on CCTV entering and exiting the premises at certain times but no information is given in the claim as to how long the alleged overstay was, nor the period of car parking covered by the parking ticket purchased.
- As the PCN was issued almost 6 months ago the defendant cannot ascertain who was the driver on the day in question.
- As the defendant was not the driver on the day in question no contractural agreement was entered into by the defendant.
- After requests from the defendant to the Claimant and BW Legal for information on the parking ticket purchased were not forthcoming an overstay of parking cannot be proven.
- In all communication forwarded to the defendant by the Claimant and BW Legal it does not state how long the alleged overstay was.
- Neither the Claimant nor BW Legal have been forthcoming with information as to the periods of grace at the site in question which are a requirement under the terms of membership by the BPA and IPC,both of which the Claimant is a member.
