Right,
Just phoned BCFP. Spoke to a woman who said the ticket was issued by an attendant who she spoke to yesterday, who said he had put it on my windscreen. Incorrect, as nothing had been put on my windscreen. Then she said the images I sent her were from PE and to take it up from them. I then asked if the attendant had issued a ticket, why are PE sending me stuff. She said she didn't know and that the attendants don't know what time you arrive, they only ticket you for parking in the wrong bay etc. She also said the PCN I had sent her she had never seen before and she'd worked there for five years. I asked then if the attendant had a copy of the ticket so I knew what offence I had committed to get a ticket from them, and she said no and then basically told me to get off the phone, if she'd known I was going to complain she wouldn't have answered the phone because it's for staff only and that I had to take it up with PE.
I am obviously complaining to PALS about her behaviour (have already called them but will be sending an email as well), but I only have today to reply to PE evidence via POPLA. What now??0 -
Did you have forum template points like 'no landowner authority' in the appeal?
If so, did PE produce landowner authority? If not, point out the omission but this only applies if you raised the point in your POPLA appeal.
If you just wrote about the machine being unclear, I would comment that:
PE have not responded to the main point of appeal, which was that it is all down to machine asking for the VRN, then displaying £2 as standard, rather than prompting the right amount as calculated by the ANPR. Patients and visitors at that Hospital are caught out in their droves, and ta 'pay on exit' system is not fit for purpose unless the data is used to show the tariff actually due.
Secondly, please refer this case back to PE to reconsider the mitigating circumstances:
I had driven from Plymouth to Barnet General to see my mum (who has type 2 diabetes, diabetic retinopathy, high blood pressure, high cholesterol, a paraumbilical hernia and some kidney issue) who had suffered a heart attack. As I left, I paid at the machine at reception, however, due to the ambiguous instructions it was unclear that the machine doesn't prompt you to pay the amount you owe based on when you entered the car park. It defaults to £2 which I paid.
In light of the extremely stressful circumstances in which I parked the car - driving for four hours through the night from Plymouth and not knowing just how ill my mum was - I must insist that you instruct Parking Eye to reconsider these mitigating circumstances, applying the Hospital appeal policy to it. People experiencing considerable anxiety when hastening to see a relative whose life is hanging in the balance cannot be expected to decipher unclear parking instructions.PRIVATE 'PCN'? Yeah that's basically what I wrote in my reply - their evidence didn't say anything about their machine signage, only the external signs. I'm not sure whether they'll go for it but I'll keep you updated. Thanks all for your help with this! I really àppreciate it.

You needed to specifically ask POPLA to refer the case back to PE to reconsider mitigating circumstances (because POPLA cannot consider them).

Exactly. I pointed out to POPLA that it was the machine signage and not the external signage that was a problem so hopefully they will take that into account. Fingers crossed0
