injury while on holiday, automatic doors closed on me while passing through them.

I am still on holiday at the hotel in Spain, I will try to explain the current situation below.

We booked with one of the large high street name brands using their website, for an all inclusive holiday, we arrived, everything has been as expected based on the reviews, food, service, rooms etc, weather has been nice too.....but a couple of mornings ago, me and my wife went for breakfast into the hotels main food hall, the enterance to the main food hall has a automatic electric double door that slides automatically open as you come into a close vancity of the doors, we passed through that one, then went to the top end of the food hall where there is seating on the outside of the food hall, same type of double glass automatic sliding doors, with sensors to detect you as people approach the doors, passed through those, then we sat down, I went to get some food, my wife waited at the table (we take it in turns, other wise people think the table is empty or you might find the table has been cleared when both returning to the table)

I picked my food and I was heading back to the outside area where my wife was sitting, but as I passed through the open glass automatic double glass sliding doors, the doors closed on me and gave both of my arms a fairly nasty knock, which knocked a number of items from the plate in my hand and left me feeling shocked, embrassed and with a sore arm (my wife witnessed this) , I brought this to the attention of a member of staff , who asked me if I would like to see a doctor, at the time I was more concerned about other guests and how this might of hurt say a child or one of the very many older guests at the hotel (mostly over 55's) any way I declined a doctor and the member of staff said they would bring it to the managers attention, we continued with our day with a sore arm and I thought hey I will be fine tomorrow.......when we returned to the room there was a letter of apology and a bottle of wine, my wife does not drink and I don't drink wine....but still a nice gesture....any way the following day been today, my arm is still sore, so I spoke with the manager today, he pretty much said to me that it was user error with the automatic doors.....! I also expressed my concerns for other guests as the same thing might happen to them , he did not seem to think it could possibly ever happen again !
I explained to the manager my arm was still sore and that I would like to see a copy of the incident record for the hotel and also a record to show the sliding door in question had been serviced and looked at after the incidient, he decline to show me either of those and I had to speak with my holiday company rep...he also said there was cameras in the area, which I was pleased about and I said "okay you and I should go and watch the footage" , he declined and said I could not see the footage.....! so I asked to see the doctor about my sore arm........doctor was paid for by the hotel, nice doctor , he examined me and prescribed me a ibuofen cream for my arm and parcetomal to be taken 3 times a day, I purchased these from the chemist and kept the prescription from the doctor and the doctors report and a copy of payment for the medication .....

I am not much of a drinker when in the UK , I tend to only drink on special occasions , birthdays , christmas and when on holiday I like to enjoy a few drinks......but I looked on NHS website and it clearly states only a small amount of alchool should be consumed when taking such medication.....so that kind of spoils part of the all inclusive benefits !

I have also discussed this with the rep, I have given him the bottle of wine and asked him to give this back to the hotel and for him to ask them not to offer me any kind of free items, as I will take this matter further upon my return, he wrote up a report and emailed me a copy.

Tomorrow I shall take photos of the area and the doors.

Therefore we arrived on the 5th, injured on the 8th , 3 days into an 11 night A.I holiday, I have spent part of my holiday time discussing this with the hotel and the manager, spent holiday time seeing a doctor, cannot really enjoy drinking much alchool due to medication and I have a throbbing arm.....I also like to use the gym when on holiday...I guess I can do leg exercisses , running and jogging machine......but making comprossies is not quite my idea of a fun time when on holiday...neither is pain, shock and embrassement....or been accused of user error when using a automatic sliding door ! It felt like I was been called an idiot.

I do have holiday insurance....but would I be just as well going through a no win no fee solicitor ?

Help and advice please......

  • What outcome do you expect?

    Sounds like the hotel have acted reasonably paying for your doctors trip etc.

    You are unlikely to suffer long term problems.

    I don't think you'll get much sympathy here.

    Thank you for your reply, so how would you feel through no fault of your own losing part of your holiday , not been able to enjoy all of the benefits of all inclusive and left with a throbbing arm? through what could really only be considered as faulty automatic sliding doors..

    I hope not to suffer any long term problems, I will see my own doctor when I am back in the UK, but enjoying a paid for holiday is all about the here and now...

    I find the situation unfair, but I guess you will of gathered that from my post.

    Just get on with enjoying the holiday.

    Forget it. You’ve been offered a reasonable resolution for what was an unfortunate incident. Anything beyond that is grasping.

    Im failing to see where you are losing part of your holiday?

    Unless you are counting the time you have spent on hereYou have been given ibruofen and paracetamol , general over the counter medicines which you don't even need a pharmacist to buy, which with all medications that you can buy come with a warning not to drink to excess whilst taking them

    You admit you aren't a drinker

    You have given yourself a bang on the arm. You have been seen by a doctor, you have been given a pain killer and an anti inflammatory, its obviously going to be slightly tender, but to the extent that you have lost 3 days of a holiday ?
