  • Agree with all your points in last post, but did not know TOC could get penalty + compensation in Magistrate court as assumed the latter only collected on behalf of government.
    Interesting part in original PCNs where it says “our client (Indigo) may pursue you to magistrate court by way of a private criminal prosecution”. Private and Criminal prosecution seem odd together..

    they may do , but the TOC would stop them

    I posted a lot of cases at my local magistrates , fare evasion etc , those cases were instigated by the likes of ital , as well as court fine and cost of ticket , compensation was given , example £5 fare , £80 compo , now i read this as compensation to TOC

    A private prosecution is indeed possible. Whether Indigo would know how to initiate one is another thing entirely.
