    So, it's an LBC. But have Gladstones complied with the law, have they provided proof of their claim, photos, proof of their charges

    Forget how they ask you to pay, they need to be legal

    GLADSTONES ..... a case on here recently showed that they did not even turn up in court ... the judge was very concerned with their incompetence and that will have been noted.

    Incompetence is a trade mark of Gladstones

    On one of the original letters there was a photo of my car and the time i got to the space and the time i left.

    I think I need to just ignore this letter until they eventually take me to court and then I can start my defence. There are so many threads I am struggling with what is most relevant to me.

    You really ought to be responding to that Letter of Claim and the first few paragraphs of post #2 of the NEWBIES FAQ sticky thread will give you good guidance on how to go about that.

    You do not ignore an LBC, what you do is tell Gladstones that they have not complied to the new protocol which is illegal and you cannot comment until they comply and unless they do, if they issue a claim you will ask the court to dismiss the claim

    You are dealing with a rubbish incompetent legal who probably don't know what day it is

    First, the alleged debt is disputed and any court proceedings will be vigorously defended.

    Secondly, despite the wholly inaccurate statement that the letter is 'fully compliant with the Practice Direction' it is in fact woefully defective and appears to be a deliberate attempt to mislead the recipient.

    Please therefore provide a Letter Before Claim which complies with the requirements of Annex A Para 2 of the Practice Direction on Pre-action Conduct:

    I confirm that I shall then seek advice and submit a formal Response within 30 days of receipt, as required by the Practice Direction.

    Please ensure that someone does actually read and respond to this letter, providing the specific information relating to the county court claim that your client intends to make against myself as the defendant to the proposed legal proceedings. Please DO NOT send a generic FAQ letter in reply as to do so does not meet the requirements of the Practice Direction and will take this matter no further forward.

    After reading through the newbies thread I think this is the correct process as the letter i received from gladstones solicitors does not comply with Annex A Para 3 in the link from the newbies thread pre-action conduct

    Can anyone confirm if i am correct here?

    That is really really old. Where did you dig that up from?

    For a start, there hasn't been an 'Annex A' in the Practice Direction for several years.
