Hi there,
Firstly, thank you very much for all the advice people give on Parking Charges. I have spent a long time reading the forums and they have helped me with appeals against UKCPS twice before due to over-zealous parking attendants (I'm sure you've heard this a few times).
This time I wish to make a complaint to UKCPS as they are making threats to take me to court over unpaid parking tickets which I ignored due to them sending incorrect paperwork. At my local gym, parking permits are given out. These parking permits state clearly that if the permits are not filled out correctly, the individual will be sent a Penalty Charge Notice. As some of you may be aware, this is directly contravening Section 11 of the IPC code of practice, that no paperwork or terms of use should imply that they have this power to issue fines. It also states that UKCPS is responsible for this, even if they use third parties like my gym to issue the permits.
However, I cannot find any way of emailing information to UKCPS apart from through CEO website, noting a Peter Haswell and I am uncertain if this is a correct email address. UKCPS have used a debt collection company called Zenith Collections who do have an enquiry address. Zenith also rather sneakily posted this letter threatening legal action on behalf of UKCPS on the 21st, threatening to take legal action in 14 days and not giving me the chance to pay the reduced charge of £160 from the original charge of.... £160 as I received it only on the 29th.
Please can someone let me know the best way forward on this? Should I contact Zenith and ask them to forward the email otherwise I will complain to IPC? Should I contact both companies threatening UKCPS with a report to IPC for several violations of their code of practice? Or should I just send a letter to IPC immediately with the complaint?

any complaint to UKCPS will fall on deaf ears and is a waste of time, so do not bother , the same will apply to the IPC, they will fob you off or ignore as welll
if you need any info from UKCPS , send a SAR to their DPO by email
only come back if you receive a legitimate LBC and/or an MCOL in the post

No debt collector can start court proceedings.
Have you not read post #4 of the NEWBIES thread - as suggested by Redx?

My apologies, I did read what was stated and I did read post 4#. My question however, was to see what constitutes as a LBC letter as I didn't see the second link on that post which answers that question (there is a bit of text). Also, would it be worth writing a complaint to IPC about the violation of the code of practice (referring to their Penalty Charge Notice) as I am getting very tired of writing two appeals (one to UKCPS and one to IAS) for every single predatory charge they hit me with.0

There is no need to write two appeals for every incident.
The NEWBIES thread makes it quite clear that a second level appeal to the IAS is pointless.
The first level appeal, to the PPC, is already written for you so not much effort needed there.
The only reason one is encouraged to even make that first appeal is to be seen to be engaging with the PPC. There is no expectation to win that appeal.
Anyway, that aside, can I respectfully suggest that you perhaps modify your parking behaviour to avoid collecting these invoices?

the CPR PaP rules which were altered in oct 2017 will tell you what constitutes an LBC that complies with those rules
what we look for are the following
did it come from the company themselves ? (or their appointed solicitors instead ?)
plus did it have a 30 day reply timescale ?
plus did it include financial forms to fill in ?
it must adhere to all the above to be a valid LBC
any letter from a DEBT COLLECTOR does not constitute a real and valid or legal LBC because they cannot issue one - period, hence why we dismiss anything written by DRPL or ZENITH or ZZPS etc
even the solicitors they sue like GLADSTONES and B W LEGAL, and WRIGHT HASSALL and QDR etc must follow those protocols if its a real LBC
if it doesnt come from the correct source and doesnt follow those PaP RULES , its not an LBC, its that simple
so anthing from a debt collector is ignored and the poster (you) is referred to post #4 of that NEWBIES thread
I do not believe that anyone issued a PENALTY Charge Notice in your case
YOU CAN AND SHOULD APPEAL EACH AND EVERY PCN, to the PPC

Just to clarify, the two appeals that I do for each incident is one to UKCPS (as requested) and one then to IAS. UKCPS automatically reject appeals regularly, hence my displeasure. I have won both IAS appeals as UKCPS did drop both cases immediately, due to mitigating circumstances and the fact that I have noted the wording error, calling their invoices Penalty Charge Notices.
In regards to getting these invoices, the parking attendant that visits the site has been over-zealous regularly, even trying to give people tickets when permits were not available. There have been several complaints at my gym (as many visitors have been unfairly charged) but as the land is owned by Network Rail, it is not easy to do anything about the issue.0 -
so its a TOC issue due to the LAND BEING NOT-RELEVANT LAND and BYLAWS APPLY ? very complicated then, hence this PENALTY wording issue
all you can do is complain to whoever hired UKCPS and/or the gym and keep on doing the double appeal seeing as it is successful
or take your business elsewhere
maybe things will change when this bill becomes law ?

all depends what they decide to do about NETWORK RAIL land, like stations etc0 -
RedX, on the full terms of use stated on the permit (which UKCPS have referred to in their invoices), it is stated that any violation of terms of use and a Penalty Charge Notice will be issued. This is against IPC's Code of Practice under Section 11. They have not issued me with a Penalty Charge Notice, but a Parking Charge Notice, which is not mentioned in these terms of use.
