I already did the AoS, and am trying to prepare my defence.
Time Line:
December 2018, received a Letter of Claim, stating if i didnt reply by 16th Jan they will issue a claim.
I sent an SAR request to Britannia and BWL which BWL have acknowledged, as receiving on the 13th Jan, they expect to reply by the 12th Feb.
No response from Britannia.
1st Feb Received Claim from the County Court (northampton)
1st Feb, Filed AoS with intention to Defend.
6th Feb, Dated 30th Jan received the 'Notice of Claim Issued' from BWL.
So, as per Coupon-Mad..
"Yep, so in your defence you can start by stating that the claim is premature and in breach of the CPRs, and in breach of the PAP re Debt claims, and in breach of the GDPR by unreasonably and unfairly processing data for a claim, before the Claimant has supplied the SAR data and information requested in good faith by the Defendant."
So that is where i am at. I will have to make a trip over to the car park and take some photos i guess, sadly most of the retail units there have now closed down.0 -
What date did you send your SAR to Brit?
Look, you have a choice
Write a defence, or dont
If you dont, I g'tee you will lose
If you do, you have a very good chance of not losing.
You only need their documetns for points around POFA compliance, nothing else.
They MUST be able to provide some documents because theyve issued a claim. They must have at least a copy of a supposed NTK, to show how the keeper was notified.
You are not the first person to presume you need a byunch of documents to write a defence, when actually, if you read the newbies thread carefully, you will see that there are SO MANY common factors in cases - standing, signage etc - that you can write those without seeing ANYTHING from the PPC.0 -
Sent the SAR on the same day as the one to BWL. So i would have expected at least an acknowledgement.
I am starting to understand i do not need their documents, and a lot of the information is helpful in the newbies thread, but, for what its worth id remind the frequent visitors to the forum that the newbies thread has likely grown over a long period of time that your knowledge of these cases has grown along with it, but for many, myself included this is the first and likely only interaction we have with the forum, that the newbies thread is huge and contains a lot of information and despite my best efforts i am still not fully understanding the process. That being said i have nothing but respect for those of you who give your time and expertise for free, and i am immensely grateful you are here to ask questions of.0 -

They have no requirement placed on them to acknowledge your SAR, they just need to respond fully to you within one month.

A perfect example of the nuance of language many of us newbies lack in regards to these proceedings, or perhaps being naive expecting courtesy from the PPC.0
