    i had a quick search on the N159 so i could see how it was different.

    re the n180 should i be willing to use the mediation service or is the advice to not use that? i assume that is just another step before a hearing if we dont agree to an arrangement.

  • So frustrating i feel like i read the newbies page carefully enough before i asked that question! Pretty sure i even did a 'find' on questionnaire. Sorry.

    Any chance someone could add 'N180' to that section?

    Also could someone explain about the N159 please?

    Why not post that on a forum which deals with legal matters? They will give you a much more in-depth explanation than a basic private parking forum.

    What will happen if the judge wants to deal with my claim without a hearing?

    The court will send you and the defendant a Form N159 (notice of allocation to the small claims track (no hearing)). The notice will tell you that the judge thinks that your claim can be dealt with without a hearing using only written evidence. The notice will ask you to tell the court if you object and will give you a date by which you and the defendant must reply. If one, or both, of you objects, your claim will be dealt with at a hearing. If you do not reply by the date given, the judge may treat your lack of reply as consent.

    I dont think i need to seek indepth legal advice to seek a clarification to a comment like the above, if someone is going to say something that open ended it seems fair enough to ask them to explain what they mean.
