    I have also taken google maps shots and intend to now involve the other retailer. Email sent today is:



    Dear X



    I have been subjected to predatory conduct by BXXX and BXX , their firm of solicitors. I have been presented with a debt of £580 and will be summoned to court in 16 days unless I pay the debt. This relates to an alleged parking contravention at the car park you rent/own/share with other businesses. I visited your MXX and CXXX on the day of question, it was my first visit to XX.



    The enclosed screen shots do not show sufficient and clear Pay and Display notifications, I may have been clearly misled as to the purpose of the car-park.


    CXX have also received a recorded delivery complaint and have failed to respond. I have subsequently written to X the local MP and will be forwarding a copy of my complaint to the Board of Directors at CXX


    BXX and BXX are widely vilified by the media and were mentioned for their conduct in the House of Commons.


    I refer to the hundreds of published cases of MXX taking action with BXXXdand other firms to avert legal proceedings against their customers, and I request your urgent assistance herein.


    If you are not willing to assist, and I am summoned to a hearing, this request and unfair contract complaint will be raised in my defence. I may also be forced to seek compensatory damages in the Civil Courts. And take steps to inform others so that your customers are not misled or subjected to these controversial companies and their practices.


    I look forward to your confirming that I will not be contacted by BXX or BXXX again. You do have permission to process my data internally only and for the purposes of halting proceedings, however the content of this email is confidential.

    Thank you for contacting Cinema
    Firstly, I would like to apologise for the delayed response. Here at Cinema we receive a high influx of queries in which we make our best effort to individually respond to as soon as possible.
    Please advised that upon discussing the issue with the Management Team at Cinema as well as our Head Office, I have been informed that are there are signs around the car parks attached to the site explaining the parking policy and the cost of parking.
    I regret t advise that you have not provided reasonable grounds to challenge the fine. We are more than happy to get involved in case where the fine had been issued in error or was grossly unfair.


    This will be our final statement in relation to your complaint. Please be advised that all further comments will be treated as a feedback and may no longer receive a response, as we have fully explained our position in the previous e-mails.

    Thanks for clarifying with a template reply that you are 'informed' there are sufficient signs.

    There are not.

    I will inform all my family and friends of your anti-customer and pro-parking scam stance and we will certainly never attend again with our custom.

    I also intend to publicise this horrendous scam in the local newspaper and on social media/TripAdvisor and other review sites, to warn other law abiding people of the distressing and potentially expensive fate awaiting them, and that you do nothing to assist a person being penalised for daring to be a customer and not having the signs and terms brought fairly to their attention in the usual way one would expect.

    Like any circumspect motorist, I and my family would pay a parking tariff if the machines and signs were clear and prominent.

    They are not, and you really do need to take on board the effect on your customers of your uninformed choice to contract with a notorious member of a private parking industry that MPs in the House of Commons unanimously described in 2018, on more than one occasion when debating how to stop this scourge, as 'operating an outrageous scam' with typically unclear signage as a form of entrapment.

    I'd send something like the above back.

    They NEED to know what people feel about this scam, and to kick out the PPC.

  • You are a v good writer mate. That is a user. I am waiting on response from the other more helpful retailer, whos car park I learn to day this is not! If I get no joy from them, who seemed to have some empathy and admitted other unclear complains from other customers. I don't want to scupper any good will on their part as they share the retail space.



    I might actually write to the CEO and note that the GM response from the cinema was not forthcoming.



    One has to be careful about how one words things that may be a threat to publicaly vilify business as that may be a case to warrant a cease and desist notice from thier lawyers. That said what sort of C ( add your own letters ) writes a response like theirs. Made me wild, as it probably has you too.



    Oddly enough the cinema use the scammers, to manage one part - and the lower ground is run by the lesser scammers, so its not even clear whos car park it is what it does or who runs it. The google images show F all.

    Hello Nice Lady.

    Result from SAR enclosed



    1 of 3 alleged offences for overstaying in a Car Park where a coffee chain operates.



    Couple of items.


    1. This is not my car registration. I sold the car. I cannot recall when. I may have been the driver. I may not have.


    2. I have now written to the MD Reg MD and Branch Man of Coffee House and nobody has responded.


    3. The case originally refered to a different operator - my mistake and Morrisons, in THAT case, have agreed to speak to the landowner but I will wait for court action before that.


    4. I chased up the MD letter ref this case today by email to his PA after calling.



    5. Google image sign I do not recall seeing in place at the time of alleged breach of unwritten contract.

    Is it likely that the new owner of your car has committed the parking act? When you sold the car (notwithstanding the fact that you cannot remember when) did you complete all the correct paperwork, i.e. send the correct bits of your V5C to DVLA to transfer ownership?

    I suspect I may have been the owner at the time of the invoices being issued. Naturally I may not also have been.



    For now I am going to assume I was.
