    The advice is to use a SAR to ask for documentation.
    Do that today.

    Parking notification: Letters from BXXX. PCN/XXXXX


    I have sent notification to you by letter requesting the following information. This has not been responded to. A copy of the signatory at XXX is enclosed.
    My letter requested the following in relation to this case and was posted on the 20th December 2018. I am concerned your handling of this request has not been prompt:


    I require:



    Evidence you have paid a debt collector in this matter.

    All photos taken of the alleged offence.

    Photos of the signage on the day in question, including close ups.
    A list of all PCNs considered against me at this time.

    PDT machine record from the day in question.

    All evidence garnered against the above that you will rely on in court.
    A copy of the original PCN.
    Details of the land owner, i.e. your client.
    Details of the relationship / contract between you and the retailer.
    An explanation on why you have not responded to my data handling request.



    I have written to XXX informing them that I have requested the above information, they have subsequently stated they will not restrict access to my data, and are sending harassing and disturbing correspondence.


    This has been brought to the board of directors at the retailer, and my local MP.



    I request that you instruct XXXX to halt proceedings against me immediately, or that the case is on hold until such time as the above has been received by me.

    Is that letter meant to be a Subject Access Request?

    If so, then it needs to state that clearly as a heading.

    Also you can only request data as it applies to you, so asking for photos of the signs in the car park for example will be rejected.
  • Well in the Stickies section, this is what is listed, but I can take that out. Confused.



    Not even sure why a SAR is going to assist but I am doing what I am told :)

    You do this to:

    - see their hand & all photos and paperwork before the court claim, and

    - to interrupt the flow of the robo-claim, and

    - to buy you time to try to get it cancelled by the landowner, by complaining, and

    - possibly to expose something wanting in their 'evidence' like happened here:

    I can see what is listed in the stickies and maybe there is no harm in trying but on the Legal Beagles site (linked) it says you can ask
    Please supply the data about me that I am entitled to under data protection law relating to myself.
    Not sure how a sign in a car park (nice though it would be to have a photo of the sign on the day) is "relates to you" and I have read posts where PPC's are refusing to provide that info under SAR. This is the sort of thing that should be requested when responding to a LBC so you know how to defend it. However, on the basis of "If you don't ask you don't get" and "Nothing ventured, nothing gained" go for it!
