Cifas Marker And Closed Account

I have especially made a naccount on here in order to ask for advice of what to do regarding my situation. I have little to no knowledge of bank terminology of what steps I need to take in my position and almost every personal banker I have discussed this with has told me "there is nothing that can be done". After a lot of research I discovered that Bank B are notorious for placing cifas markers and some people have managed to remove them although they have violated terms of the bank.

All of this started around the beginning of June 2018. I was a student in his final years of a-levels.

I did have a fruad case a couple months earlier where the details of my card were stolen(the card was in my possession at the time) and used for various online transaction in another city. Bank B sorted that out very swiftly.

At the time I didnt use my card much and had barely £200 in my current account. On June 6th I had been out revising with a couple of classmates in the local library. I did not realise at the time that my card was missing. The next day I received a text from barclays asking me whether I autherised the payment at a local petrol pump. At this point I replied "N" for no and went searching for my card. I was called immidetly by a barclays rep and I reported my card to be stolen and asked him if there was further payments which came out. He said he couldnt answer that and he can only issue me a new card and after that arrives I can discuss it.

A new card was supposed to arrive withing 3 working days. After a week, there was no sign of the card. I called the bank up again. They now tell me my account has been put under review and I would need to visit the branch. I had no idea what this meant at the time. After visiting the branch, I was made aware of various large payments made within a 48hour period andmy account was left in £198 overdraft. Whoever had my card also injected a unsually large sum of money into my account from a compromised Lloyds bank account. I immidetely raised this as a fruad case protesting my innocence and also provided bank B with a crime reference number. I also tried my best to request CCTV footage from the establishments where my card was used and was able to supply school attendance records of my whereabouts at the time of the fruaduents transactions. The police never responded to my requests for CCTV.

Despite all this, on June 16th my only bank account was closed. For the bank half a year I have been forced into using unreliable cash cards and online accounts for my everyday needs and student finnance. I am desperate to open a bank account at this stage and truely beleibe I have been wrongly done although being a loyal customer of bank B for many years.

Cifas said I have a CAT6 marker.

Id like to stress although my PIN number was used and I reported a party who I suspect is responsible, I did not compromise my details to anyone. Id really like some advice as I have no idea what step to take next,

    1. How has your PIN been able to be used ?
    Was it stored with the card ?
    Had you been shoulder surfed (probably wouldn't know this) ?


    So you requested a new card and it didn't arrive so you called them up, did you mention you hadn't had the new card ?

    How did they know the PIN ? Would the PIN not be reset (not sure if this the case)


    Is it someone you know who has done this ?


    Do you have a secure box where post is left ?


    If it were me living in halls or a flat I would get any new cards posted to a local branch so I could go and collect them.

    Category 6: First Party Fraud

    Criminal fraud by the account holder. This encompasses false loss or theft reports, significant misuse of accounts, uncleared effects frauds, direct debit fraud etc.


    Sounds like the bank don't believe the card was stolen but that you authorised the payments and then claimed fraud.

    How did they get your PIN?

    The only way I can think my PIN was compromised was by someone whithin our group of friends who I was with that day. It was the exact same day i lost my card and the payments continued that night and through-out next day afternoon. My PIN has been the same for many years but never compromised it to anyone as its the same number for my house alarm phone passcode various passwords.

    The card never arrived because it was never posted out by the bank despite the helpful gentleman stating a new card will be sent to my address(which I confirmed was correct)

    Please note that during my report to the police I informed the police of everyone I was with as potential suspects. I suspected them because of the PIN compromisation. Everyone was understanding and was willing to help with police enquiries but no law enforcment ever contacted me. Not till this day!

    I wish I knew that answer. Any assunptions I make wouldn't be very relevent as the bank doesnt seem to even want to listen to my version of events. As far as theyre concerned I have laundered money through my account.

    I'm not surprised. People are told not to divulge their PIN. Unless someone has guessed a 9000/1 shot within three attempts, you've either told someone your PIN or been careless with letting someone see it. Banks don't tend to have much sympathy in that case.

    Ill stress again. I did not at no point give my PIN volentarily. With all due respect I ddi not come here to be blamed. I feel I did nothing to compromise my PIN. I have come here for advice as I must get this cifas contested and removed. I have no idea how the process of remiving a marker happens.

    They don't apply a Cat. 6 marker without good cause
