Ignore threats and debt collectors letters from now on. This times out after 6 months.
ITAL, who hear appeals, also organise prosecutions. If they don't have your details they can't do anything. Indigo can't pass them on but if you give them over voluntarily well.....

Thanks Twhitehousescat and Waamo, I will write to the BPA and keep schtum otherwise.0

yes , super kickoff time , faulty online appeal to ital , no reply to appeal by email , as far as you are concerned you have an active appeal but are getting debt collection letters
the BPA know about the debt collector crap , they have already warned ital , ital have apologies said it was a one off and ste[d etc etc ,, never happen again
I think contact should be S Clarke , someone will link you to his email addy0 -

steve.c@britishparking.co.ukPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Dear Money Experts,
i have received PCNs for payments not made at a station car park but I did pay and have bank statements showing the money coming out of my account on the dates to Indigo Parking Services (IPS), so its either typos on my part or error on theirs..
I opened the letters late as they looked unimportant so now have 2 x £70 additional charges and debt collectors on me for total of £340. I have appealed both.
Two questions; do they have to tell what the charges on my statement were allocated against and should I go to court if pressed as I can show they have taken my money on the dates mentioned?
Thanks, really appreciate your help.0 -
why not delete your post and start a new thread , your case is different to the one being discussed here
you have obviously not read the above thread , (court? ) nor looked at the newbies thread
this is cleverly disguised and reads
"**NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? **READ THESE FAQS FIRST!** Thankyou!0 -
HI TWH's Cat,
Thanks for replying, really appreciated. I will do as you suggest, of course, as I can see how this would be more useful to the community.
I did read the newbies page and got a bit overwhelmed to be honest. There is just so much info but none if it seemed to relate specifically to my problem.
Cheers again.0 -
Read the bit that says dont look for an exact match, but understand the common parts your case has with all others
ITs a lot of info, but thats good - you cannot skim read.0 -
I emailed Steve Clark who passed it to a colleague and got a reply yesterday stating that they have looked into it and there is no breach of the code of practice and they have therefore closed the case. They also state that Indigo will look again at the appeal (your template first appeal) if we send proof that a payment was made that day.
Am I right in thinking that to do this would be a tacit admission of the presence of the Registered Keeper on the day? As stated in my original post, a parking ticket was purchased on the day, but due to an error by the ticket clerk it was for one day and not 2.
I have also received a response by email from the TOC, GTR, sympathising but also stating that it is the purchasers responsibility to ensure they have purchased the correct parking ticket, so pretty much tough titty then!
I am going to write to Indigo and formally complain that they have not provided any indication regarding the IAS nor a 10 digit code and depending upon their reply, I may also again contact BPA.
There are two things that continue to bother me, and apologies to all concerned as I do not doubt your advice, but am merely trying to understand the bigger picture:
The first is that you say that with Railway Byelaws it is only the Landowner who can issue Court proceedings, but 14 (4) makes repeated reference to Operator or authorised person. In this case, is not the PPC the 'authorised person', therefore with the same rights as the Landowner (Operator)?
The second is that this is clearly not about collecting unpaid parking charges (in this case £4.60!), but collecting the 'fine' and all escalating costs thereafter, so why can the PPC not just proceed to Magistrates Court as can any business against an unpaid debt?
I really would appreciate your comments/thoughts on the above.
You are all doing great work. We would not have had the appetite to challenge this situation had we not found this Blog Site.0
