So will I have opportunity to defend myself against their arguments despite this not being included in my defence?

Following submission of my defence I have now received a, Notice of proposed allocation to the small claims track, along with a directions questionnaire.

Is this just standard procedure? It seems a fairly simple self explanatory form. They have given a deadline of 25th July for submission.

Do I need to post this? There seems to be no other means of sending, email addresses etc

Once completed, you should return your DQ to the CCBC in the same manner and to the same email address that you sent your Defence. To refresh your memory on that, re-read post #26 above.

Remember to send a copy to the Claimant - address on your Claim Form.

You should know all this from bargepole's 'Court Procedures' thread linked in the NEWBIES FAQS under the red heading 'IMPORTANT - KNOW WHAT HAPPENS WHEN'. Sounds like you need to revisit that.

The best prepared posters report wins.

    The badly prepped ones, struggle.

Don't be in that second group.

Just a quick one? When returning my Directions questionnaire, should I send a copy to the claimant directly or should I send it to their representatives (BW Legal)? BW Legal are who sent me their copy of the directions questionnaire.

Your Claim Form has that address - in the box headed Address for sending documents and payments.
  • Got a date....I have received a letter saying that my case has been allocated to a Judge and a Court in Leeds.
Couldn't be any further away for me but is where BW Legal are based I see.

It contains a RED warning saying that i must send all documentation to the court and the other party no less than 14 days before hearing.

Any tips and advice gratefully received
  • Should I be waiting to receive their documents first so that I know what I am up against prior to filling my own?
