I am claiming costs as a company defendant? Does this change anything? Its difficult to speculate loss of earnings etc?
Also can I claim mileage to and from court @ 45p per mile? Technically as a business we already claim back mileage from the tax man anyway?0 -
Does anyone know off hand what part of the CPR says about claiming costs - loss of leave / pay, parking, mileage.
I have costs for Claimant's unreasonable behaviour, pursuant to Civil Procedure Rule 27.14(2)(g) with regards - Research, preparation and drafting of documents, Stationery, printing, photocopying and postage etc.0 -
Also sorry for all the questions but.
As I am a business defendant. If I were to lose then the costs could be tax deductible for the business. Parking fines are not, but all of the add-ons and interest etc would be. Would the payment instruction be itemised to allow me to claim back certain aspects of the costs?0 -

You're asking legal questions that are not parking-related. Suggest you pose these on a legal-focused forum such as LegalBeagles if you want expert advice.
What about your accountant for the tax-related stuff? I guess you pay him enough each year! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I thought you could only claim back the tax on on the cost of travelling? Also can I claim mileage to and from court @ 45p per mile? Technically as a business we already claim back mileage from the tax man anyway?
Or have you an arrangement where HMRC pays your business travel costs?
But then, I'm not an accountant.0 -
I don't know either. I am certainly no accountant. This stuff baffles me? I just know we can claim 0.45p per mile0

Only if he/she offers their hand, but unlikely. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

No, you tend to troop in and smile and wish him her good morning or afternoon.Should I shake the Judges Hand when meeting them?
And when you win you just say 'thankyou' and ask for your costs, and 45p per mile is perfectly reasonable, plus your loss of leave/salary, travel, parking...and try for your time reading all the paperwork and preparing your case over the weeks, at £19 per hour litigant on person rate (within reason) IF you can reel off a list of unreasonable conduct.
Google CPR costs loss of leave and read the appropriate part!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
