So Britannia parking have been in touch with me and responded to my SAR.
The letter is very simple and includes a copy of the signage in the car park as well as a copy of their privacy statement and data protection etc. In the photos they have of the signage in the car park you can see there is nothing about any legal fee of £60 which we all know they just insert which they're not allowed to do.
What should I be looking to do now? I have logged a complaint with the ICO but I dont want to sit on my laurels and just wait for a court date if I can help it, can I go back to them with anything?
Many thanks!0 -

Interesting ... no mention of the £60 ?
SAR BWLegal regarding the £60 and ask them for proof of what the sign says0 -
There is one extremely small sentence on the sign which definitely is hardly readable which says "Where parking charges remain unpaid beyond 28 days recovery charges in respect of further action may apply." What should be my next move?0

Signs that cannot be read properly or do not indicate an amount really cannot be deemed a contract.
Anyway the normal court claim consists of £50 legal costs and that is the only recovery charge they can apply0 -
So what should I do now that they've finally sent me an SAR?0
-
They haven't sent you a SAR, you submitted to them a Subject Access Request. Have they responded with everything you asked for, which should be all the data and photos they hold on you and any letters/e-mails they have sent to you?0
-
Yes the whole thing was there, all data etc, photos, the lot0

Rereading the thread it doesn't seem as if you have yet received a LBC/LBA/LBCC, so I would assume you are going to get one which may proceed to actual court papers. I would prepare myself by using all the information received via your SAR and researching the NEWBIE sticky post # 2 and in particular defences posted by Bargepole ready to write my defence if/when required.0

Hi All,
I've just received this email from Britannia parking. They're requesting an additional £10 from me for my SAR. I've copied it below and included it. What should I do with this? I am expecting court procedures if I don't do anything else so really need to know next steps to take before getting a LBCC from them. Please let me know what I should do about this and about the £10 fee being requested.
The email:
Dear Sir/Madam,
We have received your Subject Access Request, under ICO guidelines we have one calendar month to respond.
Please be aware we will send a copy of all personal data we hold only. If you have made a request for any additional information which does not qualify as personal data, please see below.
YOU’RE REQUEST FOR ADDITIONAL INFORMATION
Landowner agreement - You are not entitled to business sensitive information, it will only be supplied at court, as evidence and not before.
Contract with the driver - The contract is on the signage in the car park. A copy of the signage will be provided as evidence at court.
Machine reports - You are not entitled to transactions which do not relate to you, you will be provided with your transaction only. We are under no obligation to provide you with anything further.
Picture packs - A copy of the signage will be provided as evidence at court.
Your SAR request is free, however please be aware we are able to charge for additional copies and any requests for information we consider to be manifestly unfounded or excessive. ICO guidelines advise we are able to charge a reasonable administration fee, which is £10.
Please send a cheque payable to Britannia Parking to the following address: Data Protection Officer, County Gates House, 7th Floor, 300 Poole Road, Poole, BH12 1AZ.
Include a list of the additional information you require and the PCN number/s. Once the cheque has cleared we will action your request. We will only send additional information which is not business sensitive.
Please refer to the ICO website for further information: https://ico.org.uk/your-data-matters/your-right-of-access/
If you do not wish to pay £10, we are under no obligation to provide you with the information, your only options is to wait until this matter progresses to court, when it will be adduced as evidence.
Once you are in receipt of your SAR, all additional correspondence regarding the request for additional information will not be responded to, unless payment of £10 is received.
Many thanks0 -
They're actually trying to charge £10 for a SAR? Wow.0
