The letter from BW Legal says they will not suspend data processing unless instructed to do so by their client, right? That's what it said on mine. As you're still awaiting your SAR, you can complain to the PPC to tell BW Legal to suspend data processing and put the case on hold until the SAR has been obliged. Mention the Limitation Act.
You can respond to BW Legal in same way about their refusal but they'll likely just ignore it like they did with me.0 -

If a court claim comes, it comes. But I wouldn't sit quietly by just waiting for it to pop through your letterbox.Is there anything else I can do or just wait for a court claim?
If Britannia have had over a month to respond to your SAR and have not done so, you send them a reminder giving them 7 days to respond. It was never for BWL to reply on their behalf, and from reading the reply you reported above, I don't think they were responding to the SAR (I may be wrong, but I don't think so!).Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Did you send the email to the correct address? Their Data Protection Team email address is: DPT@britannia-parking.co.uk
However, any email sent to Britannia should've been forwarded by Britannia to the DPT. They can take a while to process these SARs (mine took 21 days, but wasn't fully obliged until 28 days).0 -

Yes I definitely sent it to their address (it was a letter) but they've heard from me so should have received, not sure why I have heard from BW though, seems odd, I'll send them an email with the same text as the letter and see what I get back0

Should they not respond within the allotted time period whats the next action I should take, are there any further steps I can take until an inevitable court date comes?0

UPDATE
Hi All,
as if by clockwork I have received an SAR from Britannia parking and a copy of the signage from the car park. As is confirmed in their photos there is no word of a £60 legal fee. They have sent attachments including my original letter as well as photos my car parked there. It also includes their data subject information statement for service users, I won't type it all out but if theres anything to include of note then I will. I will lodge a complaint with the ICO today. Is there a response necessary for this now? If so what would that be?
