    I did not put any defence as I only said this is the first time I ever heard of the claim so I didn't and still dont' know what and how they got 3 pcns on me. I only suspect it's the back of the Chinese restaurant as I said earlier but I didn't put in the defence until I see the black and white from claimant.


    There's only one optical shop other than the Chinese restaurant as the restaurant is on the top the ground floor is the optical shop so the landowner will be the optical shop.


    how are the pcns money go to split between UKCPM and the landowner. was planner to offer the landowner some payment so they could withdraw the case. It's very stressful and no party is responding my email or call requests for documents. very frustrated and annoying.

    OP - yo ureally, relaly have to understand the porocess you are in

    You MUST submit a defence, by the deadline, otherwise you lose

    Thats it. Full stop.

    Fail to submit a defence, you will have a default judgement against you

    Also, you did not need to counterclaim, and we still have NO idea why youre counterclaiming and how it cost you SO much. Thats a COMPLETE mess.

    You are in the middle of a legal process that you will LOSE if you do not meet the deadlines givne

    So you MUST submit a defence, whatever you think otherwise, or you may as wlel pay up now.
    If you TRULY WANT DOCUMENTS then send a SAR to the PARKING COMPANY data protection officer. You will get these documents back up to 30 days later, so after a defence must be submitte.d

    So we need to see the FOLLOWING INFO:

    - particulars of claim on the claim form you have in front of you
    - defence you have entered -> you HAVE entered a defence if you are at Directions Q stage
    - counterclaim you have entered

    Do not respond until you can give solid, concrete info.

    I was hoping to complaint to the local MP but now seems I don't have a case and kind of certified!!


    Still no info from solicitors or UKCPM, they may not send until the court date is set. how annoying.
  • I called up the court legal side the lady told me just to fill in the Directions of Questionnaire and provide more evidence later.


    I need to see their PCN and pictures to know what exactly they are claiming. Can't put a defence without any information. Now you all told me I have messed up in the counterclaim online process. So I'm cooked!


    When I called up UKCPM they told me to pay £550 but I have already paid the £60 online so not much difference from the whole claim they asked for.


    Any point to talk to the owner of the land and offer payment to them so they can withdraw the case?

  • Ok i'll type up what's exactly in the particular of claim


    The driver of the vehicle registration(the vehicle) incurred the parking charge(s) on 27/6/2017, 29/6/2017 & 30/6/2017 for breaching the terms of parking on the land at xxxxx street, postcode.
    The Defendant was driving the Vehicle and/or is the Keeper of the Vehicle.. AND THE CLAIMAANT CLAIMS £480 for Parking Charges/Damages and indemnity costs if applicable, together with interested of £49.32 pursuant to s69 of the County Courts Act 1984 at 8%pa, continuing to Judgement at £0.11 per day.


    That's the details in particulars of claim - I blanked the exact address of the parking. However as in the particular of the claim, my car registration no wasn't mentioned.


    The paper contains my name and current address but no car registration no. That's why I thought it was scam. Easy to get name and address of someone.


    Amount claimed £529.32
    Court fee £60
    Legal rep cost £70
    Total amount £659.32

    You are still talking about "entering a defence"

    You have already entered one. We KNOW you have entered a defence, because - and this may shock you - this is a process, and the stage you are at in the process is only possible AFTER a defence has been submitted

    So, did you fill out the claim form DEFENCE box? Did you go ONLINE and submit a defence that way? Either way, you HAVE submitted your ONE and ONLY defence, and you are now stuck with it

    So, tell us - what defence did you enter?
    If you, for the third time, state you have NOT entered a defence, I am out. Because you will have not taken the time to digest any of the posts here, nor the newbies thread, and you are just wasting my time I could help others with.

    Your call.

    OH, and the SAR - if you send it today, as I told you, you will get all doucments with your personal data on within 30 days. Easy. Or you could complain. Your choice.
  • As I said I did all those after asking all friends all told me just pay and spare the stress. Done the moneyclaim.gov.uk before I realised your site for help. I never got no PCN stuck to windscreen before and they are dating back over 17 months ago.


    I filled in the moneyclaim.gov.uk and maybe I overlooked it only offered pay half pay full or counterclaim so I picked counterclaim and in order to submit the form I had to pay £60. BUT I did not put any defence as I said this paper was the first time I heard of these PCNs. I have no information to fight or defend. As time was running out so I filed the replied online and hopefully to get solicitor side to send me info. All done before I realized this site I am with you now.


    I just called the court and they told me to call moneyclaim to see if I could change back to defence case. I'm now holding waiting to be answered by moneyclaim.


    Sorry for causing so much mess as solicitors and claimant no respond I had no choice but to file moneyclaim.gov.uk before deadline. I am fighting everything all by myself. I just don't think they should charge me so much for 3 PCNs.
