Urgent help needed please (UKPC)

Hi, could I please ask for some rather urgent advice? The reason being is that we're running out of time as due to a misunderstanding, I didn't think UKPC could obtain keeper details from DVLA.

I'm also dealing with this on behalf of a relative in the military. He's due to be deployed and will be out of the country for several months, therefore he's concerned about them taking court action or passing it on to debt recovery while he's away. This would also affect a future application for a mortgage.

A PCN was stuck to his windscreen on 28/09/2018 and a subsequent NTK arrived on 31/10/2918 demanding £100. So far I've not acted upon this and he is keen to just pay it off but I thought I'd just see if there's anything else I could do beforehand. I'm sure I've also read that when paying by card, they apply a CCA which is quite worrying.

TIA for any advice.

    Send the blue appeal text wording from the NEWBIES thread (on behalf of your relative and in his name) ASAP - you're probably just still in time for the appeal window.

    PS - it might be worth him raising a SAR on the DVLA to determine when UKPC applied for his details. I can't believe UKPC would be so efficient with their timings that they applied to DVLA for the details on (Saturday) 27th Oct, got the details from DVLA, processed them, and posted the NTK for it to arrive with the keeper on (Wednesday) 31st October. It's entirely possible that they applied for the details prior to the 27th which would mean they applied too early - which means they've misused his data, which is a GDPR breach. ;)

    Thank you so much for your prompt reply and advice. An appeal has now been submitted.

    Good point about contacting DVLA. Am I right in thinking UKPC have to wait a certain amount of time before requesting keeper details? I hadn't even considered that.

    Windscreen ticket - no access to DVLA data until day 28 after the parking event and before day 56.

    DVLA SUBJECT ACCESS REQUESTS RE RK DATA ISSUE

    You should email the DVLA and ask which organisations (and for what reason) accessed the registered keeper's data from them between a range of dates which includes the date(s) of the parking incident(s). You need to provide the registered keeper's full name and address, the address on the V5C logbook and the Vehicle Registration Mark of the vehicle involved in the parking incident.

    SubjectAccess.Requests@dvla.gsi.gov.uk

    Even though you email your request, the DVLA will respond via Royal Mail.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    As above, Day 1 is the day after the PCN, so day 28 = 27/10/2018. If they applied for details prior to the 27th then they've applied early, thus they cannot use POFA/keeper liability as they've fallen at the first hurdle. :) (Not that they care - you'd (he'd) have to make this clear in any POPLA appeal or court action if it got that far).

    No it would not, it is an invoice, just as one would get from one's truss maker.

    It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    DVLA no longer uses this email address containing ".gsi"


    Your email has been received on this occasion but please remove ".gsi" when contacting DVLA in the future.


    Beyond 31 March 2019, DVLA will no longer receive any emails sent to a ".gsi" address.

    Whatever else, your relative should complain to their MP about this outrageous unregulated scam, especially mentioning that since they are being deployed at her majesty's request, they are being disadvantaged by the scammers made up timelines.

    I'll certainly mention it to him, thank you. Although knowing him, it'll be left down to me to correspond with the MP. I usually take care of all his admin whilst he's away.

    I spotted that last week and already changed the NEWBIES thread post #5 to remove the gsi.
