Parking (Code of Practice) Bill - What Should Be In The New Code of Practice?

The problem is, how do you legislate for such outlier situations without creating a loophole that will allow MAs/ManCos to circumvent the L&T Act protections and bring in PPCs on a whim?0
-
Which we will likely try as we have a dummy clamp. Suspect the school might know the rules about clamping though!. And yes signs - as I said we are a way away from a PPC
It's more about whether folks think we would have to invoke the L and T Act in such a situation if we decided to introduce a PPC for this piece of land.
of they know the rules on clamping they also know the rules on trespass
perhaps they should be reminded0 -

Yep. I know.
That's why I am, genuinely, finding this discussion interesting and am fascinated by others views. I am not saying I am right at all but I can think of three situations on our estate (parking on the access road and blocking emergency vehicles plus the one just described) where a PPC (especially self ticketing) would be good. but I know that we wouldn't get the 75% vote cos owners aren't interested - Absentee landlords mainly - in the nitty gritty of estate management.
Two of these instances would not affect residents - except in a positive way re emergency vehicles and clear access to the estate.
We'd always try everything else first. And, again, I don't like PPCs and strongly oppose own allocated space ticketing and permits.0 -

Amazing how a few Q7, Cayenne or Range Rover wing and door panels, scattered across the street, will concentrate minds for the future.
Problem resolved. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

My understanding is that if a fire engine (in particular) is hindered by parked vehicles, it will simply plough through them, especially where a real life and death situation is in play.

Yeah I know but it would take a while with the way some of them park! And we'd end up clearing up the pieces
Plus our waste disposal guys are more fastidious and just turn round. Then residents (see above) complain when the communal bins overflow:D

No residents park there. Are you saying we should go through the L and T Act process in a case such as this? Genuinely interested.
Can you not move the gate to the end, or add a second gate?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

But it is still part of the estate. We own it. It is no different from the land inside the gate. Two residents have parking spaces outside the gates and adjacent to this piece of land.
We could but messy and expensive. Our existing gates have sensor pads in the road. And, to be honest, why should we go to that expense and trouble because of a few selfish people.0 -
True.
I think your discussion with the school is a good idea but people are always going to use the spot you have described, while it remains open. Don't ticket people for dropping off their kids.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

We wouldn't. They aren't the issue anyway as they stop outside the school and block the road.:D
No-one is bothered about someone being there for a minute to drop someone off. It's the longer periods that are the problem. Why I would want to self ticket if it ever came to it. Hopefully we will work it out with the school.0
