    Personally I think that ANPR should be banned as in council car parks, (I believe) or should be strictly controlled by specific rules and regulations i.e. To meet a minimum technical standard, timing calibration and sync, including available records on demand by appellants.


    If it is sanctioned for use it must be proper barrier control which only allows egress when the actual fee required for the duration of stay has been paid.

    This will stop double dipping, and the time on site against parked scam.

    The software could also automatically adjust for problems in exit delays by monitoring average exit timings per vehicle.


    I see no reason why the sanction points and reasons for each operator is not available for all to see, as this would also give important information showing persistent offenders, trends and loopholes in the COP/regulations.


    Also any appellant should be afforded all PPC audit information, and more specifically the information on the (claimed) annual audit of the specific car park they have been target in.


    Having seen the signage in many car parks I just don't believe that the BPA or the IPC really audit each car park as claimed. If they do they send David Blunket to do it!

    Where there is a residents management company on a private estate it should be entirely up to the directors whether or not a parking company is introduced

    I disagree, it should be voted on at the AGM or an EGM called. The directors of a company recently appointed Parkgate Aspen as MAs

    PS We are digressing. @BP is there an answer to the earlier question about purpose?

    I would have thought it was obvious. The Bill has now passed its third reading, and barring any unforeseen election, will become law next year.

    The committee responsible for drafting the statutory Code of Practice has already met a couple of times, and has produced a first draft, not yet in the public domain.

    There will be a consultation period, during which they will seek the views of interested parties. I am simply trying to gather together the thoughts of those who deal with this stuff on a daily basis, to perhaps come up with a list of suggestions (some of which may already be in the draft) of what should be included.

    The list can then be forwarded as a response to the consultation.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.
