Private parking notice but leaving the country - what to do?

    ITs that simple
    They cannot possibly raise a court claim in the UK, you are outside the jurisdiction of the E&W court

    26 minutes over does not merit a charge of £100. How have you damaged them to that extent. How much would a similar Local Authority overstay cost? It is a scam.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.

    Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

  • Thanks again to all for the input.

    Of course I totally see that the charge is unjustified and that they're scammers etc. What I don't share with you guys is:

    1) any knowledge of what I'm doing or what my "appeal" should say, at any stage

    2) the confidence and energy to fight this to the extent that this forum suggests I might need to. I CAN'T go to court (really busy few months ahead, even outside of the move itself) and I can't risk getting my brother into any difficult situations

    3) any confidence whatsoever in any aspect of this country's legal system to back an individual like me over a company, however badly they are viewed

    So with this in mind, it would really give me peace of mind to see any wording that you guys think would shut this down as quickly as possible. Any "magic words"?

    You do not have to attend court. People can win by it being heard in their absence (it's just not as good as you can't pull apart the trash the other side have put in evidence!).

    I am feeling a bit stressed about this and would really like to know:

    1) What exactly to say in my initial appeal email. 2) In your experience, how much effort will I have to put in to shut this down? I really don't have time in my life to dedicate to this, nor money to spend on lawyers etc.

    I just want to know what to say and what to expect. Thanks

    Wow you are a worrier! We've made it clear you can laugh at them and ignore any letters after ONE email!

    1) I did tell you when to send it and what to put:
    In your case there is no point using a template, and every point in waiting a bit, then sending an appeal that mainly says there is no contract and no keeper liability and you live abroad, and here's the address.

    2) None, you can ignore it after that. For goodness sake get over it, this is a scam and you have a foreign address that kills it.

  • Hey - so I appealed today and got the following speedy reply:

    "We write to acknowledge receipt of your recent online appeal, on behalf of the driver, appealing against the issuing of a Parking Charge Notice (PCN) to the vehicle.
    We note your comments and must refer you to the Protection of Freedoms Act (PoFA) 2012, Schedule 4 - Recovery of unpaid Parking Charges. This is available to view online at:

    We must therefore request that the details of the driver of the vehicle at the time of the contravention are supplied; this must include their full name and serviceable UK postal address. If you are unwilling or unable to provide these details the registered keeper of this vehicle will remain liable for this PCN. This information should be provided by 21st December 2018. Please note, Premier Park Limited will not reply to any correspondence until after the above date, if the requested information is not provided.
    If we do not receive this information by the date given, the registered keeper of the vehicle at the date of event will be held liable."

    So would you now advise doing nothing further? My appeal message was very brief, almost exactly the text suggested above and I did mention that I live in Germany.

    They are fishing for somebody to pin it on. They know they can't enforce it and are hoping to get someone they can bully into paying.
