Just taken a look on Street View. There appears to be free on-street parking in marked bays.

The signs appear to be non-compliant as they are missing the 'P' symbol. Plus you could appeal on the basis that the time stated on the PCN does not correspond with the time you actually parked or the times on the images thus "the contravention did not occur".

From your post, it appears that you have yet to appeal so aren't you jumping the gun a little? Can't see a problem in getting this dismissed at the first stage TBH.

Hopefully you are right, but my experience with these council appeals hasn't been good. Thanks anyway

Really? My experience is 100% wins by using pepipoo knowledge for Council PCNs I've helped family to escape.

    Tilt knows his stuff.

Nothing to lose by appealing and most Council PCNs can be won if you take it past the first stage appeal. They just don't tell you that.

    Hi

So I heard nothing back from Manchester City council after appealing so decided to give them a call today. I could barely understand the guy on the phone but it sounded like he said they received my appeal on the 22/11, rejected it on the 5/12 added some more costs and sent me a letter but no letter or email has arrived. I told him Id heard nothing he said to email representations@ which I did and received an auto-reply saying a reply can take up to 14 days. IS there anything else I should be doing right now ? I'm inclined to just pass to a solicitor to deal with them as they seem unfathomable, the photos are still available online but theres no info about the appeal and I've receive no further demand for payment. I'm going to be out of the UK from Saturday for at least 4 weeks with limited access to call UK numbers so want to get this sorted ASAP

No, it will cost you money and few solicitors are Council PCN experts. Pepipoo are.

If you don't receive the rejection letter and invitation to appeal to the Adjudicator, then when the Charge Notice then the Order for Recovery arrive, you can then use the OFR to apply to the TEC* to have the case re-set back to appeal stage to allow you to appeal to the Adjudicator.

But all of that would be better explained, by more informed pepipoo posters. This is easy enough to handle as long as you don't ignore the OFR.

  • Thanks -I'm off to pepipoo with this one.

Ironically I today received a really nice letter from another council rejecting my appeal for a PCN on the 14/12. I'm offered the original reduced amount of £35 or option of the adjudicator, which may end up adding costs and losing the discount, as my appeal was that I parked on the pavement not the road and apparently "red route prohibition not only applies to the carriageway but also on to the foot way and verge" :-O

Of course a red route applies on the walkway/verge as well. So do double yellows.

Can you point to the relevant legislation that says so

Pepipoo will be able to tell you that I am not wrong. Ask them, they are the experts.

You cannot avoid red routes or DYL by parking on the verge and pretending you are not in contravention of the lines, which apply from boundary/private forecourt to the centre of the road, and the same on the other side if the lines are marked opposite, too.

Here's a CAG thread about it, for going on with:

  • Thanks, I know there was some confusion about pavements and verges outside London. I have asked for clarity but am not expecting to get out of paying this one, tbh £35 was very reasonable charge for parking in this location so am happy to pay it.

The Manchester one, I will go to adjudication and have indicated I will seek costs:

Further to my email yesterday, and below, I have been back to Cottenham Street Manchester to take additional photographs to satisfy myself that no parking contravention took place.

Unless this charge is withdrawn it will taken to the Parking Adjudicator where full recovery of my costs will now be requested as I believe you have acted unreasonably when handling this based on the evidence and the adjudicator can therefore award costs. Please note that although the 28 days allowed for this may have expired, I have still not received any notice of rejection of representation, having looked online on the PCN record there is no information on my appeal status, having contacted you by telephone to try to ascertain why and now having emailed you two times you have failed to respond within the time limit allowed.

Please follow the required procedures properly so we can get this issue resolved quickly

  • When you try pepipoo do not try to sign in with a hotmail account , it won't work.
