Hi all,
I've been trawling through the posts for the past couple of days but I'm unsure where to start so if one of you can help i'd be extremely grateful!
I received what looks like a LBC on Friday 16th Nov from Brittania with a BW Legal letter attached to it saying i have 16 days from the date of the letter to pay £145. The letter was dated the 5th and i have to pay by today otherwise they will start court proceedings. Well, I have never received the original PCN that they are talking about from over 2 years ago!. I've never received any communication from Briittania Parking.
I need some help on where to go from here?
Many Thanks

To whom does it claim you should pay?
I think we need to see the letter before we can comment further.
Upload it to a web hosting site such as postimages, tinypic, or dropbox, then post the URL here but change http to hxxp. Someone here will change it to a live link for you.
Make sure you redact ALL personal data, including the hosting site username. Make sure there are no other personal images under that username.I married my cousin. I had to...I don't have a sister.

Unless they have provided you with 30 days to respond along with some forms for completion (which we advise not to be completed), this is unlikely to be a LBC.
The NEWBIES FAQ sticky, post #2 is the most comprehensive online guide to dealing with private parking court cases (from pre-LBC right up to the hearing) that you will find anywhere. And we are here to help guide you.I need some help on where to go from here?
But please note that this is not a simple, silver-bullet process, and no one here can (or will) do this for you. You have plenty of time to get to understand the game in which you are now ensnared, as there is usually a 4-5 month time lag between LBC and hearing. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

A real LBA/LBC must give you 30 days to respond and must enclose proof of their claim
You will not owe £145, BWLegal add on fake charges
They enclosed the BWLegal letter to scare you but it's only a debt crawler.
As you know nothing about this, send Britannia a SAR REQUESTING full information
DO NOT TALK TO BWLEGAL unless they send a real LBA0 -
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.
Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by in the not too distant future.

OP, have you used your real name as your forum username?
Then your really should ask MSE to change your username to something totally anonymous.
To help with that, you might like to read this short extract from The MSE Forum Guide - Frequently Asked Questions & Rules:Q. How can I change my username?
A. In most circumstances, this is not permitted.
The only reason we will change your username is if it puts your privacy at risk. This usually means you've inadvertently registered using your name, email address or something that gives away your identity within your username.
If you fall into this category, email forumteam@moneysavingexpert.com and request that it is changed, giving three alternative usernames in order of preference.0 -
Thanks all for the quick replies.
I just found this odd that i haven't had anything from Brittania Parking, no original PCN or any follow up letters etc just a letter to saying they are now passing to BW Legal!
I will ask Brittania for a SAR. The last thing i need before christmas is a ridiculous parking charge or a CCJ!0 -
Have you changed address and perhaps not updated the DVLA with your new details? The courts are too busy with the parking scammers and their dodgy legals wasting their time.
Estimate if it did go to court ... Feb Time

Do I need a template for a SAR? I've been trying to figure what I would need to write within the email.
I didn't change address, although i no longer own the car but that was only from May this year so have had plenty of time to contact me. I am trying to track down details of the land owner. I visited the Chiquitos restaurant so trying to get hold of someone in the retail chain. I don't have the same bank account as I closed it down so do not have access to statements to prove i was there nor do I obviously have the windscreen, after 2 years either! So i'm not sure where i stand with them getting this cancelled.
I want to contact Brittania Parking Ltd to explain that i have never received the parking notices and the most recent letter is the only one communication i have received from them but i'm guessing they will just ignore this!0 -
