    Not that I can see.

It's just that I do not feel able to offer good advice in that area - for any Witness Statement - not just yours.

Thank you - I got a bit worried.

I did explain to you in post #102 above that there are very few people on here who can advise on these DEFENCES and WS etc, this isnt a legal advice forum , as it says in my signature below

people not commenting means they are not comfortable in doing so, especially in a defence or WS capacity

I can probably name 4 or 5 members who can comment with certainty on your defence and WS, and in any case, the events for a WS are only known to the wtness, not the 7 billion internet users, so members usually comment on common sense or spelling errors or obvious errors like you saying London when its in fact Lancaster etc

there is no need to be worried, just accept that comments may or may not come your way, in which case use what you have got , or pay for legal advice as Martin Lewis would tell you to do for legal matters

that Newbies thread covers the basics like how to get to the court etc (which is why we keep on pointing you back at it), plus other recent court case threads on here have the printing limit and other info, its all been asked before, which is why we know, because we have read it in other threads

if you dont know, then you havent done enough research and not used the search function of this forum to its best

Yes, you have and while there may be many who may not want to comment on the WS, some experienced members probably might as they have on mine and other posts. Ofcourse you have helped in my case too and I am grateful for that. I definitely don't expect the 7 billion internet users to comment.

I appreciate what you say about only the witness statement being known only to the witness but it can be useful if someone as a 3rd party who has experience in these matters telling me that I could disadvantage myself by putting something in my WS or that somethings seem inconsistent. Ofcourse, I know that it is impossible for someone to tell me if my statements are supported correctly by the exhibits as they are not available here.

The newbies thread is very useful and I have done a lot of reading on it, not sure why you assume otherwise. I come from a fairly analytical background but it is still a lot to take in for someone who is new to it all from multiple links and threads, and inspite of the reading, may make a mistake. I now understand the process a lot better thanks to the newbies thread, other threads and all who have helped me along the way so far.

I don't mean to be awkward but am just putting forward my position in the whole thing. No offence intended at all.

good , I look forward to seeing you post in other threads instead of staying in this one because you have learned a lot more than me having been through the process for real (unlike me and KeithP etc), so your input in other threads and giving back would help a lot

once you are doing 20 or 30 a day or more, you will soon learn to recognise repeat questions that are covered in that NEWBIES thread and in other ongoing and concluded court case threads, so much so that you will be pointing the OP back to them on numerous occasions, like we regulars keep doing

welcome to the analytical advisor side of things , its unpaid, frustrating and you learn a lot about keeping cool under great strain from shouting at the screen a lot :) lol

See, you have been offended which was the last thing I meant to do. You have helped me and I am genuinely grateful. I am definitely not in a position where I can guide anyone meaningfully yet but I am reading other threads too and learning. I was following the other thread where an NHS worker got done by PE in a hotel car park where he/ she was attending something. I actually picked up on something from that thread regarding section 18.10 regarding 'change to terms and conditions' and temporary signage. I have incorporated that into my WS (I won't ask you to review it again :rotfl:).

It would be silly of me to try to even start comparing myself with you or KeithP or Coupon-Mad or Umkomaas or bargepole and many others. You have the experience and drive to help people day in day out without any financial benefit and it is most commendable. I can see the reason for your frustrations when people keep asking the same thing again and again.

The only thing I would say happens to newbies like me (definitely for me) is that when I try to read a long thread trying to understand something and there are 10 pages worth, by the time I finish reading it all and understand I am confused because I have ended up clicking and moving to multiple other threads. And then there are terms, legal speak, acronyms etc. I hope you understand. But hey, I am getting it all for free - so I am not complaining one bit.

I hope you don't carry on feeling offended by my post - it was not one bit my intention.:)

I can assure you that I am NOT offended, but I expect people to do the same as me and use the forum tools and advice to their advantage , and too many people are "hit & run" and do not give back, plus once directed at the advice (like the NEWBIES thread), I expect them to keep using that thread and only ask something that isnt in there (which is difficult because its all in there somewhere)

if you have started to help others then I apologise, but all I can see is you sticking to this one thread whereas I have already posted in a dozen threads in the last hour and I am CERTAIN that you could advise some of the others with ongoing court cases as you have been doing that same work for weeks now

my hope is that you will help others as you have been helped, to do some heavy lifting , and use what you have learned. you will learn more by doing this , same as the rest of the regulars here , but you need to start somewhere , the sooner the better

So I repeat, I am not offended , although you are assuming that I am, break down the word ASSUME and you get 3 syllables , lol :)

ps:- take a look at this thread https://forums.moneysavingexpert.com/discussion/5690655/entered-wrong-reg-on-app-messed-up-my-appeal-now and see how many times he was pointed at the NEWBIES thread and other threads, plus he is now asking for feedback on a WS, which the regulars are avoiding as they have nothing to offer

and I hope you read this thread today about a WS failure by the defendant ?

I am glad you are not. I have been following many threads and although tempted to respond to a couple, did not for fear of giving someone wrong information through my limited understanding and experience. Will try to make a positive contribution somewhere. Thanks a lot for your understanding.

Almost ready to go with WS and evidence. So I have 2 witness statements from me and my wife, and several photos as evidence of parking permit, site photos etc. I called the court today to enquire about physically dropping everything but they are pushing heavily on receiving everything by email rather than paper - so looks like it will be email.

Also enquired about what they received from PE. They have received the 'Response to Defence' that was sent to me as well but no WS or court fee. Don't they have to file a WS by the same day as me (which is next week but hearing is not until May). Umkomaas' post earlier said that their WS will come much later (and that is what I gathered from the Newbies' thread link as well). But that does not give me any opportunity to counter their statement other than during the course of the hearing. Is that the process?

I did understand that in some cases if it is sent too late I can ask for adjournment which costs them more. Do PE do that regularly to intimidate the defendant?

It's to add pressure on you.

Their WS must come under a Statement of Truth, much nearer to the hearing.

    yes is the simple answer

what they "should do" and actually do may be different, so you can complain to the judge if these issues arise

yes they must file a court fee if they want a court hearing, their claim pack and forms tell them when to pay it by (if you dont pey , you dont get a hearing and the claim is struck out)

the judge will have directed when the due dates are to both of you, or any other directions they see fit

the aim of a SAR is to get as much as you can BEFOREHAND, but they will leave signage and contracts etc until the last minute if they can, its like playing poker

Thank you. The court guy said they have another two weeks to pay the fee, so that is clearly not the same as my WS date stipulation. He couldn't tell me what the date stipulation for their WS was.

In the response to defence, they have sent pics of a signage plan and default pics showing various signage formats of visitor parking zones on site. Should I expect that they will throw up more serious evidence later on (I know it is an assumptive question) or should I expect another 100 page copy paste job?
