Credit card - refusal to help

You seem to be a person who takes everything as a personal slight irregardless of what has been said. Presumably you simply came on here looking for vindication of your views and are annoyed when people haven’t agreed.

With all due respect that's rubbish. I will defend myself when trolls come on here making judgements rather than helping with the technical query over credit card rights. You simply make a presumption as you say, and it's wrong, and yet you felt compelled to come on here and say that without offering anything on the technical query?

Look back through the thread and you will see I have thanked those who actually attempted to answer the query. If I have called anyone out, then it's because they felt the need to criticise and/or judge rather than just help with the answer over whether I have any rights.

Section 75 covers problems/disputes with the buyer, not where you changed your mind about staying because of the way you were treated. The hotel reserved your room, will have to clean it etc and they couldn't have let it out that night losing them money - the fact you chose not to stay is not their issue.

As above the best you can hope for is a goodwill gesture or token compensation.

Thank you, one of the few to answer the actual question rather than judge or criticise actions! It isn't worth mentioning that all the guests that night had a 3 hour delay on checking in due to tech issues with the hotel systems. This affected tills as well. So one could argue that 3 hours of room time was lost as we all had to put overnight cases in a storage room or leave them in cars.

I will remember section 75 and bone up a bit on credit card advantages and disadvantages. We only have the one card as we usually pay everything on a debit card except where protection might be needed.

I did email the hotel in question, and the woman (I think she might be the hotel manager) who advised me the staff had been investigated has today responded with an agreed waiver for the room/breakfast charge as we did honour the drinks bill. She has been nothing but helpful from the outset. She also offered a voucher for a discounted stay, but I have politely refused that as I just can't see us wanting to return, and also because it is only 10 miles away and staying was merely a convenience to allow everyone to have a drink and not worry about being the nominated driver.

The hotel manager has asked if I could alter the Tripadvisor review from the single star rating, and I have edited the review to review the facilities alone rather than any aspect pertaining to staff or service. I am happy to do this, as I accept that things can be poor, either service or product, and what counts is how things are corrected. In this case the hotel manager has gone out of her way to rectify this to the best possible result for both sides.

I might be miffed if I was on a roll and couldn't get a drink but humiliated? Really? I can't see why; particularly as she was not the only one refused service.

The credit card company have no liability here in my opinion. The service that you paid for was available but you chose not to use it. You will not able to make a case that being refused a drink in the bar constitutes beach of contract and your argument that staying would have been seen as an admission of some misdemeanour and endorsement of the hotels actions won't even begin to stand up.

I agree it's an unfortunate incident but you have no claim.

It was the manner of the refusal. They could have took her to one side and quietly explained but the bar person in question seemed to revel in doing it publicly, loudly and in a way that was patronising.

However I accept your technical points and today received a very polite email from the hotel manager (the senior one, not the night one) waiving the bed/breakfast fee, which was all we wanted. I've altered the tripadvisor review to reflect the hotels facilities and removed all service and staff references as requested. She did offer a discounted stay but we only live 10 miles away and staying was a convenience so no-one need be a nominated driver.

  • Playing devil's advocat here. I think you will have to pay the bill. Even if they didn't act in a decent manner it might have just been a case, sorry too late bar is shut.

I think it might have been exactly the case that they wanted to shut the bar, however they only needed to say that.

The other party refused service (not at the wedding we were at) really lost it big time and other staff were called in to stop things escalating. The threat of police was used on them, but not on us at all. As I say, they were happy to serve drinks for the bedrooms to us.

I've just looked at some of your replies to other posts. That tells me all I need to know about you. Now, this situation is resolved so you can take your trolling and unhelpful judgments and find someone else to try and dig out.

And again, I came on here for advice on a transaction and not for a judgement on an incident from people who weren't there and therefore would be better served keeping their counsel.

It's an open forum. Getting comments which (in your opinion) are not relevant is the nature of the beast. Calling people trolls as soon as they disagree with you will exacerbate that. You might want to hear that in mind for future reference.
All shall be well, and all shall be well, and all manner of things shall be well.

Pedant alert - it's could have, not could of.

How is it unfair to write a review on the experience of the hotel and some of it's staff?

Are you not aware of Tripadvisor? Part of its 'raison d'etre' is to allow people to write reviews, good or bad, on aspects of somewhere they have visited. I never mentioned the staff by name either. But I have every right to write a review based on my experience and most of my reviews have tended to be very good, with criticism applied in a constructive manner.

Go and look Tripadvisor up, you might find it useful if you ever decide to eat/drink/stay or visit anywhere of interest.

This is comedy gold, a cracking thread, oh I did eat out once it was quite nice, thanks for the tip on Tripadvisor
