H there,
So 3 years ago received a PCN for £85 from Brittania. I had no idea why, and when i questioned it was because the wrong Reg number had been entered. It was inclement weather the day it was issued so no surprise and must have been a o for a 0 or something similar. I appealed and heard nothing, just received a letter from DRP asking for an inflated figure. When I advised they had never responded to my online appeal, which oddly disappeared into the ether as soon as I pressed send with no confirmation, they advised they did via e-mail. I asked them to re-forward and all I ever got was the letter re printed and posted too me,no evidence of the original response or when it was sent. It did however advise they would reduce to a smaller admin fee and acknowledging I had paid. Of course as that never got to me on time that opportunity came and went along with the POPLA code it had contained which has also expired by then! After being advised on here to ignore all letters from debt collectors I received subsequent letters from DRP and then Zenith till early 2016 then nothing since. Till this week when I have received a letter from Britannia saying the case had been passed to bwLegal, then a letter and text messages, phone calls etc from bwLegal advising me too pay within 16 days or else. How would I know if this is a LBC? It mentions they will seek instruction to pursue me in court if I don't pay or provide reason. Surely as they have admitted I paid the correct fee, they have never provided an answer to my question on how they sense check for minor typos, they won't go to court? if it did surely the judge would throw it out?

A BW Legal Letter Before Claim will say "Letter Before/Of Claim" on it. It should be accompanied by the Annex reply forms (Information sheet and reply form plus financial statement form). It will state that further action will follow should you not reply.Always remember to abide by Space Corps Directive 39436175880932/B:
'All nations attending the conference are only allocated one parking space.'

Does that letter still say that they will accept £15?How would I know if this is a LBC? It mentions they will seek instruction to pursue me in court if I don't pay or provide reason. Surely for the £15 admin fee they have admitted they won't go to court?
As it says they 'will seek instruction' to pursue you in court, I would suggest that it is not a Letter of Claim.
As well as the shortcomings mentioned by kryten3000, a compliant Letter of Claim needs to give thirty days for a response, not sixteen days.
I say ignore that letter and wait for a Letter of Claim.
See here for your chances of court action:

They have never reverted to the £15 admin offer in the letter they claimed they sent before upping to €160 again.0

So they are considering court action for £160.
Forget that £15 offer.0 -
Funny how I never received the £15 settlement email, and when I requested it was "resent via email" it was posted to me instead. Then I was advised that as I never responded to the email I never received I owed £160!0

It's 08182990. Why?0

If they continue to harrass though is it worth quoting the long list of disputes to their requests I should pay on their customer portal?
The biggest ones being I purchased a ticket for the correct time, which they have admitted, but they have never answered my question as to what checks they have in place to ensure PCNs are not sent out for minor errors entering the VRN.
They have never provided evidence of the email they claim sent in response to my appeal, they simply re-typed it on a letter and posted it to me at a much later date.0 -
