Solicitor forgot to do Local authority search!

Hello

We were due to exchange contracts this week but at the final hour have found out that our buyers solicitor forgot to request the local authority search! This was only done on the 2nd of the month and they are adamant it’s due back this Friday so 10 working day since request. They have told my solicitor this also. They used an external search company. The local authority are quoting the standard 20 working day wait and have said they don’t expedite to my buyer! Who do we believe?

    Does it matter? Fact is, it needs doing. The date for exchange is pretty much 'wishful thinking' and you should not have organised anything yet as far as completion goes until after exchange has happened. It's not set in stone. All you can do it wait and hope I'm afraid.

    Does it matter?? Of course it matters to me! It matters because although I’m not stupid and made any plans surrounding this date, like anyone with a lot hanging on the biggest purchase of their life, a family to move and looking forward to something like this of course it MATTERS to me! I think it’s Human nature to be a bit disappointed at this stage when something should have already been done! I merely asked a question. I am aware the search needs doing, I am aware there’s nothing I can do, I am aware that quite clearly it doesn’t matter to you. So unless you have something useful or supportive to say... if it doesn’t matter then don’t comment! :T

    The comment containing 'wait and hope I'm afraid' was meant to be consoling not critical, at least by my reading.

    Of course it matters to you, but looking at it from a pragmatic perspective whether or not you stress/shout & scream/sit there and be patient - the outcome will be the same.

    I very nearly said I come across things like this regularly but I can honestly say I have not come across this particular issue in the past. There are battles you can win by being pushy and there are battles you have no control over.

    Rather than stressing, you may as well just sit back and let it be. In a months time it will be old news and you will forget about it.

    Outsourcing can be quicker than waiting for the local authority however. I think timescales can vary so is it possible - yes. Is it likely - no idea, but why would they lie? They know you are going to be on the phone on Friday. If they are anything like me, they might even be expecting it back on Wednesday/Thursday and telling you Friday to give themselves a little bit of wiggle room in case there are delays (under promise and over deliver as they say).

    It doesn't matter who you believe or not, the fact is you won't be exchanging until it arrives and there's nothing you can do to expedite the process.

    One of the biggest life lessons that I ever learned is that there is no point in getting stressed about things over which you have no control.

    I'm outa here. Too bitey for me. Only here to help. And NOT a good idea to tell someone not to comment unless they have something supportive to say. It's an open forum. If you don't like it, block me. If you only want people to come back with 'awww hun, that must be awful, can't you go camp out in their office or go to the press, then try mumsnet. You'll get the wrong info, but at least they'll be 'supportive'. I've been here a bloody long time to help people like you. Maybe check my other posts and see who has the attitude...

    Ah come on. Put yourself in their shoes, they are mega stressed. Things can be mis-read when online.

    Im the first to be grumpy but buying a home is stressful at the best of times. When someone else messes up so late in the day it is easy to see how you can become highly strung.

    I would read the situation that the oversight was noticed. As the request was made on the 2nd. A provisional date of the 16th was therefore suggested. Contract exchange dates often move. A provisional dates just keeps everyone focussed. No last minute holidays being booked etc.
