I will provide as much information about this case that I can when I feel able. I have suffered with severe depression all my life, and right now I feel like stringing myself up (not over this matter, but it hasn't helped). There is probably much to learn from my failings, which were many; I was far too confident for one. I'm sure not now.0

If I come across as having a chip on my shoulder I apologise. I'm not criticizing anyone on the forum and appreciate everyone who has tried to help. There are many things I didn't do in hindsight, probably due to personal matters in my life that relegated this matter way down the line of importance. I'm just really upset at myself, failing my wife and when combined with the personal matters I broke. I came home from the court case and sobbed. We all have breaking points. Just to reiterate that I don't hold anyone accountable for my actions and decisions and I am extremely grateful for all the help and advice. I'm sorry for venting, and (once I've calmed down) maybe people can learn from my mistakes, which were many.
You really need to start putting the wheels in motion with regards to taking this up with the car park owner, there has been some advice in this thread on how to proceed.
One of the things i would strongly recommend is that you post complaints/ your intentions etc up on here first as well.
another question, were you given the right to appeal the decision? From the Plain Language Commission:

It is very stressful for some to have to deal with these parasites, that is why MPs are doing their best to sort matters out. Sorry I was a bit harsh with you previously, but the only way for you to get justice is to stand your corner. You never know how far you can go until you go too far.0

It's not the requirement to display a BB per se but the BB demonstrates the entitlement to use a disabled space.I have to ask - everything points to the blue badge scheme not applying to private parking areas, so therefore there would be no need to display one anywhere in a private car park, particularly as the car park in question is free.0 -
Also, the requirement is part of the signage, and the signs form the contract. If you park in a disabled space without displaying a BB the PPC are perfectly entitled to claim that you have breached their contract and entitled to damages.
Our argument is that, once they are aware that someone in the vehicle has a BB, they should cancel the PCN.You never know how far you can go until you go too far.0 -
Agree with the appeal, asked only as a point of interest, it would appear that the judge may have made their mind up before the case started, coupled with a poor defence/angle of attack. Also, the requirement is part of the signage, and the signs form the contract. The signs could have said Red cars in Red bays only, blue cars in blue bays onlyFrom the Plain Language Commission:

They could indeed, and if someone with a purple car parked there, the PPC would be perfectly entitled to make a claim for BOC. What a judge might make of that I can only imagine. You never know how far you can go until you go too far.0 -
Magenta Car parked in a bay for red cars, Cyan Car parked in a blue bay, theres zero regulation and the parking companies can do as they please.
And if the so called code of practice from whatever trade association they belong to is too troublesome they can either ignore it ( and not much action will be taken) or their friendly trade association can re-write it to better suit its membersFrom the Plain Language Commission:
