Please help - Parking charge notice - Devious new tactic involved -

Hi everyone, could someone please help with this parking charge notice handed unfairly by Gallan Parking limited in Birmingham- This could be a new tactic that will be used by other car parks in the future.
My car was in one of their car parks and the payment amount of £2.70 was paid ( the normal cost that it has been for the past year or so) . The car has then had a parking charge notice on it – I automatically assumed that this was a mistake and would be cleared with a phone call. The operator explained on the other side that the full amount was not paid so the ticket was only valid for 3 hours .
The operator has then explained the price had changed - so at some point in the night/early light these crooks had come out and changed the pricing boards above the machine and upped the price to £3.80 . I visited thee car park to check and the boards had been changed – so these crooks with no prior notice or even a period of leniency had changed the signs. I believe it is such an underhanded and devious tactic they deserve nothing.
Obviously the fully expected people not to notice as no prior signs or notices had been shown and then suddenly the price had changed on one random morning when your half asleep!
The fine says 14 days it’s at £60 and £100 for anything over.
PS I think they are on the BPA website but all ticks apart from the last one ( ticket) are crossed out i.e debt collection , anpr etc I am not sure what this means!

Hi, and welcome. What should I do at this point -
At this point you should read post #1 of the NEWBIES FAQ sticky thread.
In there you will find an already written for you blue text template appeal.
Send it unchanged - no additions or alterations necessary.
Send it as the keeper.
Having done that, you might want to look at the BPA's Code of Practice.
In particular:18.10 Where there is a change in the terms and conditions that materially affects the motorist then you must make these terms and conditions clear on your signage. Where such changes impose liability where none previously existed then you must consider a transition to allow regular visitors to the site to adjust and familiarise themselves with the changes. Best practice would be the installation of additional/temporary signage at the entrance and throughout the site making it clear that new terms and conditions apply. This will
ensure such that regular visitors who may be familiar with the previous terms become aware of the new ones.0 -
Complaint to Gallen and the BPA. From their Code18.11 Where there is any change in the terms and conditions that materially affects the motorist then you should make these clear on your signage. Where such changes impose liability where none previously existed then you should consider a grace period to allow regular visitors to the site to adjust and familiarise themselves with the changes.
You might just get them sanctioned. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

That would be good, another BPA rogue trader
If the BPA kicked out all their scammers, would they survive0 -
Make sure you DO NOT blab about who was driving though in any appeal or complaint!
A tiny firm like this lot is almost certain to have failed to use the POFA to hold a keeper liable, so a keeper appellant holds the winning hand that MUST NOT be discarded in the rush to complaint/appeal.
That's why you need to read the NEWBIES THREAD first...
...and why you need to urgently EDIT and DELETE sentences in your post that tell the world ''I parked''!!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.
Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by early in the New Year. You never know how far you can go until you go too far.0 -
Your name isnt ( or deosnt contain the word) Hasan in it does it?From the Plain Language Commission:

They have done it in Birmingham in all their car parks (they own a quite a few) they are just on derelict land with no or poor lighting and safety but people are forced to park their as they have no choice.
Sorry for being silly but am I missing something which template do I use can someone provide me the link or copy and paste it I would be so grateful. and to get this right no mentions of my name (what if my name is in my email address?!)
I would advise everyone to be careful as this happened over night and to all of their car parks it maybe a new tactic employed by these thieves0 -
Please re-read the first reply you received on this thread.Sorry for being silly but am I missing something which template do I use can someone provide me the link or copy and paste it I would be so grateful.
I really do not think anyone can be clearer in pointing you towards the template appeal you should use.
No. Why aren't you reading what has been written?Shall I refer to the act that someone provided in this thread about notifying drivers of a change prior and having a grace period?
I wrote:Send it unchanged - no additions or alterations necessary.0 -
you need to edit all your posts here including the last one, no mentioning who was driving, not even to the people on this forum, nor to anyone else, its a secret, no blabbing , so never use the following words "MY , ME , MYSELF & I"
Its the KEEPER, and the DRIVER, nothing else
the blue text template "one size fits all" is in post #1 of the NEWBIES FAQ sticky thread, third thread down from the top of this forum
you should have read it before posting, so edit your posts, then read it, then appeal as KEEPER using that blue text template with no alterations
assume that we know what we are doing, and you dont , its easier that way0
