So just an update, I filed both defences by first class post to CEL and UKCMP However, both are saying they haven’t received my defence. I have postage certificates, but the courts are still asking for directions from the judge As the court is also saying one of the defences hasn’t been received even though I hand Delivered both defences at the same time and in time!! . I am reaching the end of my tether and becoming incredibly distressed as I feel as though these company crooks are going to get away with adding these CCJs to my credit file. What can I do?

You need to make a complaint to the Court Manager and explain that both defences were hand delivered together on the same day, so maybe they clipped one behind the other. I'd start by phoning him/her (only speak to the Court Manager or Supervisor responsible for this mess).

You have proof of posting to the Claimants as well so you have the high ground.

Thank you. Would it be a good idea now to use the MCOL tool for both Companies now for acting vexatiously for a counterclaim? Or should I wait until after this has been put to bed?

You are not at a counter claim stage. Wait and get this all sorted first.

    ok.. Hi all, HNY!

Its been some time since I've posted here as after I got the two CCJs successful set aside I didn't hear anything from either Gladstone's or CEL. However, today I received a witness statement in the post which suggests that CEL paid the £25 re-list fee and are trying to pursue the PCN again. In their pack it includes the witness statement, photo evidence of the parking lot and signage of where the old signs were (I've since gone back to the car park and CEL contract has been removed as its now a free parking space) They've included a lot here - I cant honestly remember much surrounding that day as it was nearly 4 years ago since the alleged offence but it looks pretty sturdy. They've offered me a settlement of £100 within 7 days or it proceeds to court. what are my next steps please?

sorry I will also mention that the time for CEL to pay the £25 was 24th December 2019. received a witness statement today dated 09/01/2020. So wouldn't they be out of time anyway? Also haven't received a court date thus far from my local so Im guessing either they're trying to pull a fast one or backlog?

I'd be worried the court is still using your old address and you've missed something.

    Isn't it obvious?

Find out if the court is using your current address and if they are not, correct them.

Yes, which I will do but cant right now as its a Sunday........

Im questioning about after I find out the information of when the court date is/ if they have a correct address? or if there is one at all. As I cant just sit and do nothing............. is there any more preparation I would need to do in response to the witness statement etc?
