    Assuming they have got an enforcement order Inform them you have a set aside hearing (including a hold on enforcement pending it's outcome - you have put that in your set aside application haven't you???)

    Ask (tell!) them to hold off!

    Yes, I have. However i havent got a date yet for the hearing just an acknowledgment its been transferred to my local court. The enforcement agents are dcbl and I know them from the scummy channel 5 show. So Im just a bit apprehensive they will still come anyway just to add their enforcement fee. I've also not got a email for them as I'd much rather put things in writing than verbally!

  • well I'm not sure. The letter was titled "Pre-enforcement letter" and the contents say taht there could be a further impact on me such as writ/warrant to control goods, placing a charing order or obtaining an attachment of earnings. I think these are just fancy words to scare me into paying?

    Unless the CCJ is in excess of £600 (can't see from a skim read of the whole thread) Paul Blowjob and Co won't be knocking at your door, so your X-Box and 75" TV are safe!

    So no order, this is just a threatening debt collection attempt.

    You would get notified were the claimant applying for an enforcement order

    Write to Gladstones informing them that, as the CCJ was obtained without your knowledge, you are seeking a set aside.

    Mention also that, at the set aside hearing you shall also be querying the make up of the £260, which you believe contained some unlawful amounts, and that and that all enforcement action must be put on hold.

    I urge you to report this grubby law firm to their regulatory body, the SRA.

    How about also reporting Paul B and Co to the ICO for using an old address, and threatening High Court when that cannot happen for a debt well under £600. You have to report companies separately so may as well complain about DCBL as well.

    As someone who has first hand knowledge of a person killing themselves after being evicted, I think the TV show glorifying what they do to people is atrocious. And whilst there is a place for bailiffs, there are rules, and DCBL are not the do-gooders the show tries to suggest.

    CERTAINLY report Gladstones, now, online to the ICO (easy to find the complaint section and choose 'concern about handling your data' and show the proof you told them your address in July...and also complain that they passed your WRONG address to DCBL despite knowing it was wrong, and have not called DCBL off either, despite knowing now, that the CCJ(s) are to be subject to a set aside hearing.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
