Horizon Parking Fine on Private Land

Hi All,
As the keeper of vehicle Horizon parking have sent me a parking notice for allegedly parking on double yellow lines marked on private land (with a 15 min parking restriction).
The ANPR cameras have picked up the reg but the rest of the image is pretty poor and dark.
I had moved and therefore have also missed the opportunity to pay the cheaper £40 and now they are demanding £70.
What are the suggestions for action?

You send the template appeal, as advised last time you had one of these. At least Horizon offer POPLA and I believe they do not use POFA wording, so the usual templates will work as long as the driver is never admitted.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

My proposed response is as follows:
Dear Sir/Madam:

I challenge this 'PCN' as keeper of the car.
The parking space where the alleged parking offence took place is adjacent to 1AS which is a building used by The Co-operative Group. I will be lodging a complaint direct with the CEO (Steve Murrells) as well as the Director of Estates (David Roberts). If this ticket is not cancelled due to its inappropriateness and exponential charge, I have intention to discuss operating rights that have been granted to Horizon Parking and ensure that these are revoked.
Furthermore, I believe that your signs fail the test of 'large lettering' and prominence, as established in Parking Eye Ltd v Beavis.
Further, I understand you do not own the land and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You have omitted clear information about the process for complaints including a geographical address of the landowner.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge. Furthermore, the notice you sent by requesting my data from the DVLA means that you have used an old address which I as the registered keeper do not reside at. I am in the process of changing address and therefore did not receive your letter from the old property until xx xx xx which negates any timescales you have detailed there within.
Please note, I intend to pursue the components of this fine from all perspectives. I will be engaging with the Co-op Estates and Internal Relations department to review the contractual obligations between Horizon Parking and the Land Owner and pressing for a management meeting to discuss the charges that are being levied by Horizon Parking and whether the Co-op as an ethical business can continue to allow such parking practices exist on land procured by them. I hope in the interests of this and the other components detailed in the letter above, you can reconsider the charges.

Makes no sense.
There is allegedly a small bay which stretches around 6 car lengths that is marked in double yellow lines. It is a highly unusual spot as it not part of main road but rather the private development of 1AS. Cameras have been installed and the pictures of the alleged vehicle have been taken from a lamppost and are date stamped. I am assuming this was some sort of camera. Perhaps not an ANPR ?:cool:0 -

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement. There will be no admissions as to who was driving and no assumptions can be drawn.
Since your PCN is a vague template, I require all photos taken, a clear image of the signage and an explanation of the allegation (e.g. if you have identified a wrong VRN input at a machine, say so, and explain why your Data Protection Officer has not simply rectified it, rather than trying to punish a driver for a matter where there is nothing to deter).
I will be making a formal complaint about your predatory conduct to your client landowner and to my MP, appraising all parties of the debate where Parliament agreed: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists...should not have to put up with this''. Firms of your ilk were unanimously condemned as operating an 'outrageous scam' (Hansard 2.2.18). The BPA & IPC were heavily criticised; hardly surprising for an industry where so-called AOS members admit to letting victims 'futilely go through the motions' of appeal and that 'we make it up most of the time' (BBC Watchdog).
Formal note:
Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service.

It is widely thought that most PPCs don't bother to read appeals, let alone understand any arguments.

I guess I was hoping to find a middle ground and try to give a fuller appeal in the hope of not fighting two tickets at the same time :-S:cool:0
