Then are you sure you were parked a Fistral Beach? The invoice is from parkingEye and i have appealed via their website.
Isn't Fistral Beach managed by Smart Parking?
And Chorley is in Lancashire, not Lincolnshire. The address on the invoice is from Parking Eye Chorley Lincs
Detail really is important.
Ah... just seen your latest edit.0 -

Made me laugh
OP - may I suggest you change your thread heading to say Tower Road Newquay - just for ease when others search for similar assistance.“You’re only here for a short visit.

So it was Tower Road (up the road a bit from Fistral)?
Not Fistral beach (Smart Parking infest that one, since ParkingEye were kicked out)?
Either way, you will win as a registered keeper appellant, but with ParkingEye they go further and will want to see the whites of your eyes at POPLA.
But anyone with a Golden Ticket will win, as long as they point out to POPLA it's 'non-POFA' and they do not give away who was driving.

Yes, just one visit on holiday...it was close to a beach... I have read about this company and had the jitters about appealing , but I have to try. I ve had worse than this to tackle , and its no small change they are asking for.
Had an email noting my appeal, I shall complain to MP and whoever tomorrow .
Best keep my sunglasses on then eh?0 -
Nope, you can't lose with a Golden Ticket. Did they send it late, after 14 days? More fool them!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Makes me feel better and what persuaded me to not lie back and pay.
Yes..date of event 14.10 .18
date issued 27.10.18
I received it Nov 1st although no date stamp on the envelope
I need to read up a bit more to understand all this a bit better, I realise that they have invoiced me as registered keeper and have no idea of the driver, and i cannot be made to tell them. Hence it would be hard for them to take me to court .
Dont understand though why they do that and not send me the other invoice, not complaining though0 -
Because they are busy/staff on holiday, or the ''scam victim pile'' that week was too high to get through them quick enough.
They won't have planned to drop the ball but they do, on quite a few, hence why the NEWBIES thread post #3 shows a PE Golden Ticket and declares that these are winnable (you'd have to try very hard to lose this, you know!).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello, Hope you are all well.
I have recieved a reply from Parking Eye and as expected they want to know the driver of the vehicle.
I have read somewhere that I need a code or number in order to appeal? There does nt seem to be one on the letter I received . I will double check to see what my next step should be, but would appreciate confirmation from the forum.
I ll copy/paste the email I received. There was only 2 x 6 digit numbers across the top of the email.
This is what they wrote :
It is ParkingEye’s position that this charge has been issued correctly and that we had reasonable cause to request the Registered Keeper’s details from the DVLA following a breach of the terms and conditions of parking in operation on site. For your information, we are authorised by the ICO to collect and process data for the purpose of car park management, which includes dealing with appeals and any subsequent recovery action required.
We can confirm that our lawful bases for processing data are Performance of a Contract and Legitimate Interests. Please note that ParkingEye do not rely on Consent as a legal basis for processing data when issuing and pursuing the payment of outstanding Parking Charges
As stated within the Parking Charge Notice, the driver of the vehicle is responsible for payment and we ask that you provide details for that individual if you were not the driver. We therefore wish to confirm that we have rejected your request that we remove data from our system in this instance. Please note that you have the right to make a complaint to the ICO in respect of this response, should you wish to do so. You may also seek a judicial remedy.
