]Good evening,
Thank you for all the very useful advice on this forum about private car parking charges. I have spent several hours reading, trying to decide whether to just pay up or contest the charge.
I have followed a thread by Talkgirluk on Holy Trinity Church as its very like my problem,and think I can use a lot of the info there.
The only question I have , Does it matter that there is no receipt.?

I do have the "Golden Ticket " type of notice as there is no reference to the POFA in the letter I received. So am I right in assuming I have a good chance of having this charge cancelled as its addressed to the keeper of the vehicle

One other thing I noted, on another quite good site, ParkingEye has had their contract revoked from this site, and operated by another company. Its all very confusing .

    Do not forget to complain to the Newquay Tourist Office, as well as your MP.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
    You never know how far you can go until you go too far.

    Not at all, given:

    So use the template first appeal as keeper, and do not give or imply the driver, in any appeal stage and the keeper then wins.

    100% winnable at POPLA, as long as the PCN you describe is not just the 'Reminder' (that doesn't have the POFA on it anyway).

    Its £100 to be paid within 28 days discounted if I pay within 14... Nothing about it being a reminder. and it was also issued 13 days after the event and I received it on Nov 1st
    I cannot see anything that indicates its a reminder

    Really is a dirty business , making me a paranoid parker !!

    I'm afraid that's what people are going to have to be if they are to avoid being ram-raided by private parking companies. Private car parks are increasingly being infested by ANPR cameras.

    The more paranoid, the better!

    Smart parking PCN is non-POFA, we all know that.

    Apologies! It was a bit of a shock to receive the invoice as my holiday was at the beginning of October
    My invoice was for Fistral Beach which seems to be notorious. it has the parkingeye cameras, and also a ticket machine.
    I am using the information on the thread for Holy Trinity as its very similar to mine and to save time and questions where I can.

    I have just sent the appeal on their website, I suppose nothing ventured, and its a lot of money for 20 minutes on an almost empty car park. The keeper of the vehicle lost a mobile phone on the way to the beach, but i realise mitigating circumstances don't alter things.
    The signage was not clear on the car park.
    The letter was sent out of time and does not specify its followingPOFA , and just sent to me as the keeper, asking me to inform them who the driver was at the time.

    And its a lot of money!!! a weeks pension in my case

    To be truthful.... this lady here not aware of the scams and thievery of these carparks.... bit of a wake up call for me. :(

    You're still not clearing this up.

    If it is the Fistral Beach Car Park, it will not have ParkingEye (of Chorley, Lancs) there. Those cameras up on poles are not 'parking eyes', they are Automatic Number Plate Recognition (ANPR) cameras.

    At Fistral Beach, the car park is infested by Smart Parking Ltd. please confirm which company has sent you the postal notification of the parking charge (invoice).

    Sorry, Didnt realise the differences. Its the number plate recognition, I have 2 pictures of my car entering and leaving. The invoice is from parkingEye and i have appealed via their website.

    I used the template after reading the threads and going to the Newbie part.
    I did read the thread of the Holy Trinity lady and added the bit about it out of time as she has.

    The address on the invoice is from Parking Eye Chorley Lincs

    The car park address is Tower Road Newquay which has a path down to fistral beach, may be thats where i m getting you confused.?
