    No, that's not how to play a POPLA appeal, it is more likely to be won on GRACE PERIODS alongside proving the fact he is disabled.
    my dad won't be able to cope with any more threatening letters in the meantime. or indeed afford to pay the £100 increase if it fails. he's on benefits as it is.
    Then send a letter signed by Dad, to CEL, telling them 'my address for service has changed to (give YOUR address). Then any letters won;t ever come to him to worry him.

    You can genuinely tell him he will hear NOTHING more and that you will handle the POPLA appeal in his name (use an email address you create and use).

    Search the forum for GRACE PERIODS KELVIN POPLA (advanced search, and change the menu bottom left, to show results as POSTS).

    IMHO you need more than Guys Dad has posted, you MUST have the usual points about no landowner authority etc.

    Who is this independent retailer?

    Ultimatly they are responsible for the actions of their agents, and if they - through the actions of their agents have not made any reasonable adjustments for someones disability then they will/could be in some difficulty.
    the parking company should have dropped this like a hot potato once they knew there is a disability/equality act issue at play, not to mention the 10 minutes extra time - if it was 10 minutes that is.


    However thats not how PPC operate, they want the money, and they will use whatever pressure tactics they can, from so called early payment discounts to scary letters that ramp up the pressure.
    Quite a few people ( but not all) with a disability may be in a vulnerable situation, and will want any hassle to be got rid of quick - at the same time without causing even more hassle, so this group is easy prey for PPC land.


    If you state who this independent retailer is, and where they are then help can be tailored to resolving this situation

  • as an update: yes, everything i said was accurate including the 10 minutes overstay. because it has been mentioned about the retailer, and they are independent, i decided it would be worth a trip to see them. i spoke to a manager, explained that i would likely win an appeal to popla.... the manager was actually very nice and disclosed he was fed up with this company. they introduced it several months ago in order to stop neighbouring ind units using their car park but it has had such a negative impact on his customers. the outcome was that he phoned yesterday to say he had the PCN cancelled with CEL. very relieved to say the least. i'm astonished at the staggering amount of these situations just on this website and in awe of you people who show such interest in helping us. i sure would have followed your advice and so very grateful for the pointer back to the retailer. i for one will be reading every car park sign in future. many thanks everyone. :j

    That's good news. You must get this in writing for proof.

    They need to get CEL kicked out, plenty of others have.
