PCN Parking ticket worry issues

Hi can anyone help me please. I’ve received a PCN notice. I went to the cinema with my 89 year old grandma and my 8 year old daughter. My grandma is disabled and can’t walk far. There were no disabled spaces so had to park further away which meant I had to look after my grandma and daughter. The blue badge was on display but what I didn’t realise was that it was no concessions for blue badge holders. I’ve telephoned the cinema but they have said they have no ownership of the car park so weren’t interested. I’ve not paid anything to date, have tried to appeal but got another notice saying pay £100. What do I do??? It’s making my grandma very upset.

    Have you read the sticky thread for NEWBIES yet? This will provide you with many of the answers you need without having to ask them again here.
    It's a good idea to print or write down the acronyms from post 5 of the NEWBIES.

    What was the date the NTK was received as opposed to the date sent?

    How did you appeal? BY post, email, or online using the PPC's website? You should have used the method stated on the NTK.
    Did you give away the driver's identity when you appealed?

    Did you get a rejection letter?

    The blue badge scheme does not apply on private land. This is explained in the booklet that comes with the BB and various UK Gov web sites. Not everywhere allows free or discounted parking, and that includes council car parks.

    The letter was received after the appeal date as it was sent to my old address so missed the 30 day early payment.
    I appealed by email not giving away driver details
    I don’t know what an NTK is???
    Yes I got a rejection letter it wasn’t an appeal as such just a standard I’m not getting into a contract with you off another website.
    It was the first time my grandma had been out due to her I’ll health and we naively assumed it was ok for bluebadge holders. Due to disability and also supervising my 8 year old the last thing I did was look at signage.

    Unfortunately you are living in a different age now, it's the age of greed, not fluffy wuffy parking attendents, and excuses about not looking at signage have got you in a pickle.


    The discount is actually a bribe to get you to pay up and shut up by the scamming parking company.


    Not too much to worry about, it's not a fine it's an invoice, and Euro aren't fond of the courts anyway.


    One further point though, have you changed the registration address details with the DVLA, that could get you into trouble if not.

    Which is why I pointed you to post 5 of the NEWBIES and suggested you print off or write down the acronyms so you wouldn't need to come back and ask questions that are already answered.

    The NEWBIES isn't something you can skim read. You need to sit down in front of a full sized PC, not a 'phone, and go through it making notes of what is relevant and what isn't.

    Not at court stage? Don't need to read post 2 in detail (yet).
    Not an IPC member? Don't need to read anything about that.
    Not at debt collector stage? No need to read about that (yet)

    … and so on.

    If you are sure you didn't reveal the Driver's identity, you should edit your posts to remove information about who did what. Only ever refer to The Driver and The Keeper.

    Did you get a PoPLA code with your rejection? Did the PPC reply to your current address or your old one?

    Not all parking places have free parking for disabled drivers. It is the driver's responsibility to check t&c before parking.
    It is the responsibility of the parking company to provide clear signage to convey the t&c and, of course, have the landowner's authority to operate there.

    You will need to challenge these two points by comparing the signs to the requirements of the trade association that the PPC belongs to and demand proof of their authority to act.

    One other possibility is they failed with their NTK. What was date of event and dad on NTK?

    That is not quite true. The Law, (The Equality Act), requires that service providers make "reasonable adjustments" to cater for the "protected characteristics" of those covered by the Act. However, I doubt that free parking is one of them.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    Hi thanks for your reply I’ve never used these sites before so was just asking for advice. If I’d known about them I’d have come here first. I don’t know what s POPLA code is. The return was all via email not to current address. Did try and look at all the posts on their but there is so many it’s confusing hence my question. It’s really worrying my grandma and she just wants me to pay it. So much so she thinks I’m going to lose my job...
